The bill introduces a new section to chapter 69.50 RCW, allowing individuals charged with specific controlled substance-related offenses to seek dismissal of their charges upon successful completion of a certified substance use disorder treatment program. To qualify for dismissal, individuals must undergo a certified assessment that evaluates their criminal and substance use history, confirming the presence of a substance use disorder that necessitates treatment. The treatment program must be court-approved, and individuals must submit the assessment report, proof of completion, and the underlying police report to the court by the readiness hearing.

If the required documentation is submitted on time, the court is mandated to dismiss the charges, and these filings will be kept under seal. Additionally, if the individual faces other charges related to the same incident, the court has the discretion to dismiss those charges as well, unless the prosecutor raises an objection. This legislation aims to provide a pathway for rehabilitation and reduce the legal consequences for individuals who demonstrate a commitment to addressing their substance use issues.
