This bill amends existing laws regarding industrial insurance coverage for posttraumatic stress disorders (PTSD) specifically affecting correctional facility workers and direct care registered nurses in Washington State. It establishes that PTSD is considered an occupational disease for correctional facility workers who have been employed for at least 90 consecutive days. The bill introduces a prima facie presumption that PTSD is an occupational disease for these workers, which can be rebutted by evidence. Additionally, it outlines that this presumption extends for a period of three months for each year of employment, up to a maximum of 60 months after the last date of employment.

The bill also modifies the existing definitions and conditions under which PTSD claims are processed for various public safety workers, including firefighters and law enforcement officers. It specifies that PTSD will not be considered an occupational disease if it is directly attributed to disciplinary actions or similar employer actions. Furthermore, it mandates that if a claim is appealed and the decision allows for benefits, the opposing party must cover all reasonable costs associated with the appeal, including attorney and witness fees. The act is set to take effect on January 1, 2026.
