This bill amends existing laws regarding industrial insurance coverage for posttraumatic stress disorders (PTSD) specifically affecting correctional facility workers and direct care registered nurses. It establishes that PTSD is considered an occupational disease for correctional facility workers who have been employed for at least 90 consecutive days. The bill introduces a prima facie presumption that PTSD is an occupational disease for these workers, which can be rebutted by a preponderance of evidence. Additionally, the presumption extends to claims made within three months for each year of employment, up to a maximum of 60 months after the last date of employment.

The bill also clarifies that PTSD claims for correctional facility workers are not considered occupational diseases if they arise from disciplinary actions or similar employer actions taken in good faith. Furthermore, it includes provisions for the reimbursement of reasonable costs, including attorney and witness fees, for successful appeals related to these claims. The definitions of "correctional facility worker" and "direct care registered nurse" are also provided to ensure clarity in the application of the law. The act is set to take effect on January 1, 2026.
