SUBSTITUTE SENATE BILL 6198

READ FIRST TIME 02/05/24.
1 AN ACT Relating to employees of the law enforcement officers' and
2 firefighters' plan 2 retirement board; and amending RCW 41.26.717.
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
4 Sec. 1. RCW 41.26.717 and 2018 c 272 s 2 are each amended to
5 read as follows:
6 The law enforcement officers' and firefighters' plan 2 retirement
7 board established in section 4, chapter 2, Laws of 2003 has the
8 following duties and powers in addition to any other duties or powers
9 authorized or required by law. The board:
10 (1) Shall hire an executive director, and shall fix the salary of
11 the executive director subject to periodic review by the board and
12 ((in consultation with)) shall provide notice to the director of the
13 office of financial management and ((shall provide notice to)) the
14 chairs of the house of representatives and senate fiscal committees
15 of changes;
16 (2) Shall employ other staff as necessary to implement the
17 purposes of chapter 2, Laws of 2003. ((Staff must be state employees
18 under Title 41 RCW)) All employees of the board are exempt from civil
19 service under chapter 41.06 RCW. Compensation levels for all staff
20 employed by the board shall be established and fixed by the board
21 subject to periodic review by the board. The board shall provide

1 notice to the director of the office of financial management and the
2 chairs of the house of representatives and senate fiscal committees
3 of proposed changes to the compensation levels for the positions;
4 (3) Shall adopt an annual budget as provided in section 5,
5 chapter 2, Laws of 2003. Expenses of the board are paid from the
6 expense fund created in RCW 41.26.732;
7 (4) May make, execute, and deliver contracts, conveyances, and
8 other instruments necessary to exercise and discharge its powers and
9 duties;
10 (5) May contract for all or part of the services necessary for
11 the management and operation of the board with other state or
12 nonstate entities authorized to do business in the state; and
13 (6) May contract with actuaries, auditors, and other consultants
14 as necessary to carry out its responsibilities.
