1 AN ACT Relating to promoting access to information regarding the
2 long-term services and supports trust program; and adding a new
3 section to chapter 50B.04 RCW.
4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
5 NEW SECTION. Sec. 1. A new section is added to chapter 50B.04
6 RCW to read as follows:
7 (1) The department of social and health services shall develop a
8 secure internet portal through which individuals may access the
9 program summary statement described in subsection (2) of this
10 section. The department of social and health services and the
11 employment security department shall work collaboratively to identify
12 data needs required to create the statement described in subsection
13 (2) of this section. The employment security department shall provide
14 agreed upon data to the department of social and health services to
15 populate the statement in the secure internet portal. When developing
16 the secure internet portal, the department of social and health
17 services may use or modify existing systems, such as the benefits
18 application management system developed by the department of social
19 and health services. The secure internet portal must be operational
20 no later than January 1, 2026.

1 (2) Beginning April 1, 2026, and by April 1st each year
2 thereafter, the department of social and health services and the
3 employment security department shall, through the secure internet
4 portal developed under subsection (1) of this section, make a program
5 summary statement available to each employee that has been assessed a
6 premium by the program under RCW 50B.04.080. The program summary
7 statement shall provide the employee with individualized information
8 explaining:
9 (a) The number of hours that the employee was reported to have
10 worked in the previous calendar year;
11 (b) Whether the employee worked the minimum number of hours
12 required under RCW 50B.04.050(3);
13 (c) The number of years that the employee has been recorded to
14 have worked the minimum number of hours required under RCW
15 50B.04.050(3);
16 (d) The projected benefit level for the employee at age 75; and
17 (e) Program information, including information related to
18 becoming a qualified individual, information related to becoming an
19 eligible beneficiary, information about the assessment process,
20 current assessment and benefit unit levels, information regarding
21 verifying one's program information and correcting any errors, and
22 any other relevant program updates.
23 (3) The statements available through the secure internet portal
24 in 2026 must include information on calendar years 2023 and 2024.
25 (4) The employment security department and the department of
26 social and health services shall maintain information on their
27 websites on how an employee may access the employee's program summary
28 statement through the secure internet portal.
