SUBSTITUTE HOUSE BILL 2182

1 AN ACT Relating to the creation of a data dashboard to track
2 policies, funding, and program and health outcomes related to the
3 sale, consumption, and use of regulated substances; and adding a new
4 section to chapter 66.08 RCW.
5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
6 NEW SECTION. Sec. 1. A new section is added to chapter 66.08
7 RCW to read as follows:
8 (1) The board, in consultation with the department of health, the
9 health care authority, and other agencies the board deems
10 appropriate, shall publish in a conspicuous location on the board's
11 website and update, at least annually, the information identified in
12 subsection (2) of this section.
13 (2) The following information, identified separately for each
14 substance regulated by the board, must be published under this
15 section:
16 (a) Compliance rates, with all personally identifiable
17 information redacted, regarding the board's enforcement of laws or
18 rules prohibiting the sale of liquor, cannabis, cigarettes, tobacco
19 products, and vapor products to persons under 21 years of age;
20 (b) The number of citations, with all personally identifiable
21 information redacted, issued annually for violations of laws or rules

1 prohibiting the sale of liquor, cannabis, cigarettes, tobacco
2 products, or vapor products to persons under 21 years of age;
3 (c) The number of citations, with all personally identifiable
4 information redacted, issued annually for violations of laws or rules
5 prohibiting the sale, service, or delivery of liquor to an
6 intoxicated person or a person who is apparently under the influence
7 of liquor, and for violations of laws or rules prohibiting the
8 purchase or consumption of liquor by a person who is apparently under
9 the influence of liquor;
10 (d) Data from the healthy youth survey about youth use, access,
11 and perceptions of liquor, cannabis, cigarettes, tobacco products,
12 and vapor products in Washington;
13 (e) Information reported to the board from the department of
14 health or the health care authority about the prevalence in
15 Washington state of the use of alcohol, cannabis, cigarettes, tobacco
16 products, and vapor products;
17 (f) Information reported to the board by the department of health
18 and the health care authority about the amount and source of funding
19 appropriated or available per fiscal year to the department of health
20 and the health care authority for programs for preventing and
21 deterring the use of liquor, cannabis, cigarettes, tobacco products,
22 and vapor products and treating substance use disorders related to
23 these regulated substances;
24 (g) Available data reported to the board by the department of
25 health or the health care authority about:
26 (i) Annual health care expenditures in the state caused by
27 liquor, cannabis, cigarettes, tobacco products, and vapor products;
28 (ii) Annual state medicaid total health expenditures caused by
29 consumption or use of liquor, cannabis, cigarettes, tobacco products,
30 and vapor products;
31 (iii) Cessation expenditures for cigarettes or tobacco products
32 through the school employees' benefits board and the public
33 employees' benefits board;
34 (iv) Annual deaths in Washington caused by smoking or consuming
35 cigarettes, tobacco products, alcohol, vapor products, or cannabis;
36 (v) State spending on tobacco prevention and cessation funding as
37 compared to funding levels recommended by the United States centers
38 for disease control and prevention;
39 (vi) Health equity metrics including disparities in the rates of
40 diseases or disorders caused by or associated with the consumption or

1 use of alcohol, cannabis, cigarettes, tobacco products, and vapor
2 products; and
3 (vii) Demographic impact metrics including disparities in the
4 rates of consumption or use of alcohol, cannabis, cigarettes, tobacco
5 products, and vapor products;
6 (h) The amount of the following taxes, fees, and penalties
7 collected by the state in the most recent fiscal year:
8 (i) Taxes collected from the sale of liquor, cannabis,
9 cigarettes, tobacco products, and vapor products;
10 (ii) License fees collected related to the manufacture,
11 distribution, and sale of liquor, cannabis, cigarettes, tobacco
12 products, and vapor products; and
13 (iii) Money received from penalties imposed by the board on
14 licensees for violations of laws related to the manufacture,
15 distribution, or sale of liquor, cannabis, cigarettes, tobacco
16 products, or vapor products; and
17 (i) The number of occurrences of, and economic impact on the
18 regulated market from, the:
19 (i) Inversion of cannabis or cannabis products into the regulated
20 cannabis system involving a person licensed under RCW 69.50.325 as a
21 cannabis producer, processor, or retailer, purchasing or obtaining
22 cannabis or cannabis products from an unauthorized person or source;
23 and
24 (ii) Diversion of cannabis or cannabis products out of the
25 regulated cannabis system involving a person licensed under RCW
26 69.50.325 as a cannabis producer, processor, or retailer, selling or
27 transferring cannabis or cannabis products to an unauthorized person
28 or recipient.
