1 AN ACT Relating to prescription labels for medications used for
2 abortion; and amending RCW 18.64.246 and 69.41.050.
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
4 Sec. 1. RCW 18.64.246 and 2013 c 19 s 18 are each amended to
5 read as follows:
6 (1) To every box, bottle, jar, tube, or other container of a
7 prescription which is dispensed there shall be fixed a label bearing
8 the name and address of the dispensing pharmacy, the prescription
9 number, the name of the prescriber, the prescriber's directions, the
10 name and strength of the medication, the name of the patient, the
11 date, and the expiration date. The security of the cover or cap on
12 every bottle or jar shall meet safety standards adopted by the
13 commission. At the prescriber's request, the name and strength of the
14 medication need not be shown. If the prescription is for a
15 combination medication product, the generic names of the medications
16 combined or the trade name used by the manufacturer or distributor
17 for the product shall be noted on the label. The identification of
18 the licensed pharmacist responsible for each dispensing of medication
19 must either be recorded in the pharmacy's record system or on the
20 prescription label. This section shall not apply to the dispensing of
21 medications to inpatients in hospitals.

1 (2)(a) Notwithstanding subsection (1) of this section, at a
2 prescriber's request, the prescription label for abortion medications
3 may include a prescriber's national practitioner identification
4 number or health care facility name instead of the name of the
5 prescriber.
6 (b) For the purposes of this subsection, "abortion medications"
7 means substances used in the course of medical treatment intended to
8 induce the termination of a pregnancy including, but not limited to,
9 mifepristone.
10 (3) A person violating this section is guilty of a misdemeanor.
11 Sec. 2. RCW 69.41.050 and 2003 c 53 s 325 are each amended to
12 read as follows:
13 (1) To every box, bottle, jar, tube, or other container of a
14 legend drug, which is dispensed by a practitioner authorized to
15 prescribe legend drugs, there shall be affixed a label bearing the
16 name of the prescriber, complete directions for use, the name of the
17 drug either by the brand or generic name and strength per unit dose,
18 name of patient and date: PROVIDED, That the practitioner may omit
19 the name and dosage of the drug if he or she determines that his or
20 her patient should not have this information and that, if the drug
21 dispensed is a trial sample in its original package and which is
22 labeled in accordance with federal law or regulation, there need be
23 set forth additionally only the name of the issuing practitioner and
24 the name of the patient.
25 (2)(a) Notwithstanding subsection (1) of this section, at a
