The bill aims to address the impacts of mass layoffs by identifying demographic disparities among affected employees and enhancing their access to information about available relief options. It mandates the development of a mass layoff survey and data collection system by October 1, 2024, which employers subject to the federal Worker Adjustment and Retraining Notification (WARN) Act must distribute to impacted employees. The survey will collect anonymous demographic data to assess the effects of layoffs on protected classes and will be provided at no cost to employees, who will have at least 30 days to complete it. Employers are also required to submit general demographic data about their workforce to the department within 45 days of providing the surveys.
Additionally, the bill establishes provisions for rapid response partners to assist employees receiving termination notices under the WARN Act. Employers must provide reasonable access to these partners, who will present resources and services to help employees navigate the transition following a layoff. The access must occur during regular working hours and last for at least 90 minutes, although attendance is voluntary. The legislation emphasizes the importance of supporting affected employees through education and resources to mitigate the disruptions caused by mass layoffs.
