This bill amends RCW 9.94A.753 to require individuals convicted of driving under the influence (DUI) offenses that result in the death or permanent disability of a parent or guardian to provide financial support to the minor children or dependents of the victim. The court is empowered to order restitution in the form of financial support until the child or dependent reaches the age of 18. In determining the amount of support, the court will consider various factors, including the financial needs of the child, the resources of the surviving parent or guardian, and the standard of living to which the child is accustomed. Payments are to be made to the court clerk for remittance to the surviving parent or guardian, and any amounts paid by the defendant or their insurance for lost wages will offset the restitution amount.
Additionally, the bill modifies existing provisions regarding restitution, including the adjustment of the restitution payment schedule based on changes in the offender's circumstances and the court's authority to relieve offenders of restitution obligations if they lack the ability to pay. The bill also clarifies that restitution must be ordered in all cases where the victim is entitled to benefits under the crime victims' compensation act. The amendments include changes to the numbering of subsections and the insertion of new language to address these requirements.
