1 AN ACT Relating to housing authorities; and amending RCW
2 35.82.300.
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
4 Sec. 1. RCW 35.82.300 and 2002 c 258 s 1 are each amended to
5 read as follows:
6 This section applies to all cities and counties.
7 (1) Joint housing authorities are hereby authorized when the
8 legislative authorities of one or more counties and the legislative
9 authorities of any city or cities within any of those counties or in
10 another county or counties have authorized such joint housing
11 authority by ordinance. For legislative authorities that have created
12 housing authorities prior to the effective date of this section, a
13 joint housing authority may be formed by two or more city governments
14 without county legislative authority authorization.
15 (((2))) The ordinances creating a joint housing authority must:
16 (a) Provide for the creation of a new public body corporate and
17 politic; or (b) Provide that a housing authority created under this
18 chapter and previously activated by resolution of one of the
19 legislative authorities creating the joint housing authority will be
20 converted to, and will thereafter operate as, a joint housing
21 authority.

 1 (3) The ordinances enacted by the legislative authorities
2 creating the joint housing authority shall prescribe the number of
3 commissioners, the method for their appointment and length of their
4 terms, the election of officers, and the method for removal of
5 commissioners.
6 (((3))) (4) The ordinances enacted by the legislative authorities
7 creating the joint housing authority shall prescribe the allocation
8 of all costs of the joint housing authority and any other matters
9 necessary for the operation of the joint housing authority.
10 (((4))) (5) A joint housing authority shall have all the powers
11 as prescribed by this chapter for any housing authority. The area of
12 operation of a joint housing authority shall be the combined areas,
13 defined by RCW 35.82.020(6), of the housing authorities created in
14 each city and county authorizing the joint housing authority.
15 (((5))) (6) The provisions of RCW 35.82.040 and 35.82.060 shall
16 not apply to a joint housing authority created pursuant to this
17 section.
18 (7) Unless a delayed date is specified in the ordinances
19 providing for the creation of a joint housing authority, the creation
20 of, or conversion to, a joint housing authority will take effect upon
21 the latest effective date of the ordinances providing for its
22 creation.
