This bill establishes a cooperative agreement between the Washington State Department of Transportation and the Lummi Nation for the construction of a public roadway. The new road will begin on Rural Avenue at the southern boundary of Ferndale city limits, traverse tribal trust property, and connect to Kope Road. The bill includes provisions for the location, design, construction, and maintenance of the roadway, which will be named upon completion. The Lummi Nation will be responsible for the operation, maintenance, and future improvements of the roadway once it is constructed.
Additionally, the bill authorizes the Department of Transportation to determine the roadway's location in consultation with the Lummi Nation and allows for the request of a temporary construction easement from the Lummi Nation for the project. The cooperative agreement will also grant the Lummi Nation the authority to construct road intersections or grade separations and may permit them to convey easements to the United States for roadway improvements as required by federal regulations.
