1 AN ACT Relating to authorizing bona fide charitable or nonprofit
2 organizations to conduct shooting sports and activities sweepstakes;
3 and adding a new section to chapter 9.46 RCW.
4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
5 NEW SECTION. Sec. 1. A new section is added to chapter 9.46 RCW
6 to read as follows:
7 (1) The legislature hereby authorizes bona fide charitable or
8 nonprofit organizations to conduct, without the necessity of
9 obtaining a permit or license to do so from the commission, shooting
10 sports and activities sweepstakes permitting wagers of money, and the
11 same shall not constitute gambling or lottery as otherwise prohibited
12 in this chapter, or be subject to civil or criminal penalties
13 thereunder, but this only when the outcome of such sweepstakes is
14 dependent upon the score, or scores, or the shooting ability, or
15 abilities, of a shooting sports contest between individual shooters
16 or teams of such shooters, conducted in the following manner:
17 (a) Wagers are placed by buying tickets on any players in a
18 shooting sports contest to "win," "place," or "show" and those
19 holding tickets on the three winners may receive a payoff similar to
20 the system of betting identified as parimutuel, such moneys placed as
21 wagers to be used primarily as winners' proceeds, except moneys used

1 to defray the expenses of such shooting sports contest or otherwise
2 used to carry out the purposes of such organization; or
3 (b) Participants in any shooting sports contest(s) pay a like sum
4 of money into a common fund on the basis of attaining a stated number
5 of points ascertainable from the score of such participants, and
6 those participants attaining such stated number of points share
7 equally in the moneys in the common fund, without any percentage of
8 such moneys going to the sponsoring organization; or
9 (c) An auction is held in which persons may bid on the shooters
10 or teams of shooters in the shooting sports contest, and the person
11 placing the highest bid on the shooter or team that wins the shooting
12 sports contest receives the proceeds of the auction, except moneys
13 used to defray the expenses of the shooting sports sweepstakes or
14 otherwise used to carry out the purposes of the organizations; and
15 (d) Participation is limited to members of the sponsoring
16 organization and their bona fide guests.
17 (2) For purposes of this section, "shooting sports" means
18 shooting sports and activities such as target shooting, skeet, trap,
19 sporting clays, "5" stand, and archery.
