1 AN ACT Relating to certain surveys performed on in-home services
2 agencies; creating a new section; and providing an expiration date.
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
4 NEW SECTION. Sec. 1. (1) By October 1, 2024, the joint
5 legislative audit and review committee in consultation with the
6 department of health, the department of social and health services,
7 and other appropriate stakeholders, shall conduct a performance audit
8 analyzing the on-site monitoring, state licensure, and validation
9 surveys performed on in-home services agencies as referenced in
10 chapter 70.127 RCW. The analysis must include, at a minimum, the
11 following components:
12 (a) An evaluation of:
13 (i) The current process that the department of health, the
14 department of social and health services, and area agencies on aging
15 use to perform oversight and surveys on in-home services agencies
16 including, but not limited to: The in-home services agencies subject
17 to surveys, the frequency of the surveys, and who is performing the
18 surveys; and
19 (ii) Auditing and monitoring assessment tools utilized during the
20 on-site monitoring, state licensure, and validation surveys with a

1 focus on analyzing how surveys are performed, the length of the
2 surveys, and the differences between the tools;
3 (b) A determination of whether the current auditing and
4 monitoring assessment tools are ensuring that in-home services
5 agencies are complying with state and federal laws and regulations;
6 (c) A determination if the current process and compliance models
7 are the most efficient available and accurately measured, do not
8 duplicate survey efforts, and ensure in-home services agencies are
9 complying with state and federal laws and regulations; and
10 (d) A review of any duplication of surveys conducted while
11 ensuring that the in-home services agencies are meeting the standards
12 outlined in state and federal law.
13 (2) The joint legislative audit and review committee shall submit
14 a final report on their findings to the appropriate committees of the
15 legislature by October 1, 2024, and shall submit a progress report by
16 December 1, 2023.
17 (3) This section expires December 31, 2025.
