This presumption can be rebutted by a preponderance of evidence and extends to claims made within three months for each year of employment, up to a maximum of 60 months after the last date of employment. Additionally, the bill outlines provisions for the reimbursement of reasonable costs associated with appeals related to these claims.

The bill also modifies RCW 51.08.142 to clarify that the rules regarding mental conditions and disabilities caused by stress do not apply to occupational disease claims resulting from PTSD in both firefighters and direct care registered nurses. It specifies that PTSD is not considered an occupational disease if it is directly attributed to disciplinary actions or similar employer actions. The effective date for this legislation is set for January 1, 2024.
