READ FIRST TIME 02/16/23.
1 AN ACT Relating to posting of approved courses and providers of
2 continuing education on equity-based school practices, the national
3 professional standards for education leaders, and government-to-
4 government relationships, which is currently required for
5 administrators and teachers; amending RCW 28A.410.277; and adding a
6 new section to chapter 28A.410 RCW.
7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
8 Sec. 1. RCW 28A.410.277 and 2021 c 77 s 1 are each amended to
9 read as follows:
10 (1) The Washington professional educator standards board must
11 adopt rules for renewal of administrator certificates and teacher
12 certificates that meet the continuing education requirements of this
13 section.
14 (2) To renew an administrator certificate on or after July 1,
15 2023, continuing education must meet the following requirements: 10
16 percent must focus on equity-based school practices, 10 percent must
17 focus on the national professional standards for education leaders,
18 and five percent must focus on government-to-government relationships
19 with federally recognized tribes.
20 (3) To renew a teacher certificate on or after July 1, 2023, 15
21 percent of continuing education must focus on equity-based school

1 practices. This subsection (3) does not apply to a person renewing
2 both a teacher certificate and an administrator certificate.
3 (4)(a) Except as provided under (((b))) (c) of this subsection
4 (4), continuing education must be provided by one or more of the
5 following entities, if they are an approved clock hour provider:
6 (i) The office of the superintendent of public instruction;
7 (ii) A school district;
8 (iii) An educational service district;
9 (iv) A Washington professional educator standards board-approved
10 administrator or teacher preparation program;
11 (v) The association of Washington school principals; ((or))
12 (vi) The Washington education association; or
13 (vii) Other organizations approved by the Washington professional
14 educator standards board.
15 (b) ((Continuing)) Beginning with the 2025-26 school year, the
16 professional educator standards board must approve clock hour
17 providers under this section through a revised application process.
18 As part of the revised application process, entities must submit an
19 application to the professional educator standards board that, at a
20 minimum, includes the following:
21 (i) The entity's mission and vision;
22 (ii) The entity's experience and expertise in providing
23 professional development to educators generally, as well as specific
24 experience and expertise in equity-based practices;
25 (iii) Possible subject matter topics of continuing education to
26 be provided by the entity;
27 (iv) Information on clock hour pricing;
28 (v) Transcript processes; and
29 (vi) Other application elements deemed appropriate by the
30 professional educator standards board.
31 (c) To meet the requirements of subsection (2) of this section,
32 continuing education related to government-to-government
33 relationships with federally recognized tribes must be provided by
34 one or more subject matter experts approved by the governor's office
35 on Indian affairs in collaboration with the tribal leaders congress
36 on education and the office of Native education in the office of the
37 superintendent of public instruction.
38 (((5))) (d) The office of the superintendent of public
39 instruction and the Washington professional educator standards board

1 must maintain a list of subject matter experts approved under (c) of
2 this subsection on their respective websites.
3 (5) An entity providing an administrator or teacher continuing
4 education program focused on equity-based school practices or the
5 national professional standards for education leaders must publicly
6 post the learning objectives of the program on its website. If the
7 entity does not have a website, it must post the learning objectives
8 of the program in a conspicuous place in the entity's main office and
9 submit a copy of the learning objectives to the Washington
10 professional educator standards board.
11 (6) Continuing education focused on equity-based school practices
12 must be aligned with the standards ((for cultural competency
13 developed)) of practice developed by the Washington professional
14 educator standards board under RCW 28A.410.260.
15 NEW SECTION. Sec. 2. A new section is added to chapter 28A.410
16 RCW to read as follows:
17 (1) By September 1, 2024, the Washington professional educator
18 standards board must develop a process for the temporary or permanent
19 revocation of continuing education provider status.
20 (a) Continuing education provider status may be revoked for
21 providers that meet any of the following criteria:
22 (i) Providers that receive a substantial number of complaints
23 filed against the provider, as determined by the board;
24 (ii) Providers found to not be in substantial compliance with RCW
25 28A.410.277; or
26 (iii) Providers found to offer course material that is not in
27 substantial alignment with the cultural competency, diversity,
28 equity, and inclusion standards of practices adopted in RCW
29 28A.410.260, as determined by the board.
30 (b) Entities authorized to submit a complaint under this section
31 are limited to the following:
32 (i) Educators;
33 (ii) Local education agencies;
34 (iii) The office of the superintendent of public instruction;
35 (iv) Organizations representing principals;
36 (v) Organizations representing school board members;
37 (vi) Organizations representing school administrators;
38 (vii) Labor organizations representing classified instructional
39 staff; and

1 (viii) Labor organizations representing teachers.
2 (2) By December 1, 2024, the professional educator standards
3 board in consultation with the office of the superintendent of public
4 instruction must submit to the relevant committees of the legislature
5 a report on how to implement an auditing system of continuing
6 education providers and other recommendations for improving the clock
7 hour system.
8 (3) For the purposes of this section, "approved provider" and
9 "provider" have the same meaning as "approved in-service education
10 agency" in WAC 181-85-045, but apply only to providers of
11 administrator or teacher continuing education programs focused on
12 either equity-based school practices or the national professional
13 standards for education leaders.
