READ FIRST TIME 02/01/23.
1 AN ACT Relating to the sale of cannabis waste; and adding a new
2 section to chapter 69.50 RCW.
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
4 NEW SECTION. Sec. 1. A new section is added to chapter 69.50
5 RCW to read as follows:
6 (1) A licensed cannabis producer and a licensed cannabis
7 processor may sell cannabis waste to a person not licensed under this
8 chapter if:
9 (a) The cannabis waste would not be designated as dangerous or
10 hazardous waste under:
11 (i) Chapter 70A.300 RCW and rules adopted under that chapter; and
12 (ii) Cannabis waste disposal rules adopted by the board;
13 (b) The licensee notifies the board and the Washington state
14 department of agriculture before the sale. Such notice must include
15 information about the quantity and sale price of cannabis waste
16 transferred and the name of the person or entity that purchased the
17 cannabis waste; and
18 (c) The licensee makes all sales available to the public on an
19 equal and nondiscriminatory basis.
20 (2) Cannabis waste not sold in accordance with subsection (1) of
21 this section and not designated as dangerous or hazardous waste under

1 chapter 70A.300 RCW, rules adopted pursuant to that chapter, or
2 cannabis waste disposal rules adopted by the board must be rendered
3 unusable before leaving a licensed producer, processor, or
4 laboratory.
5 (3) For the purposes of this section, "cannabis waste" means
6 solid waste generated during cannabis production or processing that
7 has a THC concentration of 0.3 percent or less. "Cannabis waste" does
8 not include "hemp" or "industrial hemp" as those terms are defined in
9 RCW 15.140.020.
10 (4) Nothing in this chapter prohibits producers or processors
11 from selling cannabis waste to a person not licensed under this
12 chapter if such transfer is pursuant to the requirements of this
13 section.
14 (5) The board may adopt rules necessary to implement this
15 section.
