SECOND SUBSTITUTE HOUSE BILL 1299

1 AN ACT Relating to workforce development in the beverage alcohol
2 industry; and amending RCW 66.44.318.
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
4 Sec. 1. RCW 66.44.318 and 2021 c 123 s 1 are each amended to
5 read as follows:
6 (1) Except as provided in this section, nothing is construed to
7 permit a nonretail class liquor licensee's employee or intern between
8 the ages of ((eighteen)) 18 and ((twenty-one)) 21 years to handle,
9 transport, or otherwise possess liquor.
10 (2) Licensees holding nonretail class liquor licenses are
11 permitted to allow their employees between the ages of ((eighteen))
12 18 and ((twenty-one)) 21 years to stock, merchandise, and handle
13 liquor on or about the:
14 (a) Nonretail premises if there is an adult ((twenty-one)) 21
15 years of age or older on duty supervising such activities on the
16 premises; and
17 (b) Retail licensee's premises, except between 11:00 p.m. and
18 4:00 a.m., as long as there is an adult ((twenty-one)) 21 years of
19 age or older, employed by the retail licensee, and present at the
20 retail licensee's premises during the activities described in this
21 subsection (2).

1 (3)(a) Employees of ((a domestic winery)) licensees identified in
2 (b) of this subsection who are at least age 18 but under 21 years of
3 age may engage in ((wine production and work in a winery's)) the
4 manufacture and production of liquor as authorized under the terms of
5 their employer's license, and may work in the licensee's production
6 facility, so long as there is an adult age 21 years of age or older
7 on duty supervising such activities on the premises. Nothing in this
8 subsection authorizes ((a winery)) an employee under age 21 to taste,
9 consume, sell, or serve ((wine or)) liquor.
10 (b) This subsection (3) applies to all licensees with privileges
11 for manufacturing or producing beer, wine, spirits, or any type of
12 liquor under a license issued under this title.
13 (4) Any act or omission of the nonretail class liquor licensee's
14 employee occurring at or about the retail licensee's premises, which
15 violates any provision of this title, is the sole responsibility of
16 the nonretail class liquor licensee.
17 (5) Nothing in this section absolves the retail licensee from
18 responsibility for the acts or omissions of its own employees who
19 violate any provision of this title.
20 (6)(a) Licensees holding a ((domestic winery)) nonretail class
21 liquor license are permitted to allow their interns who are between
22 the ages of ((eighteen)) 18 and ((twenty-one)) 21 years old to engage
23 in ((wine-production)) liquor manufacturing and liquor production-
24 related work at the ((domestic winery's)) liquor licensee's licensed
25 location, so long as the intern is enrolled as a student:
26 (i) At a community or technical college, regional university, or
27 state university with a special permit issued in accordance with RCW
28 66.20.010; and
29 (ii) In a required or elective class as part of a degree program
30 identified in RCW 66.20.010(12)(b).
31 (b) Any act or omission of the ((domestic winery's)) liquor
32 licensee's intern occurring at or about the ((domestic winery's))
33 liquor licensee's premises, which violates any provision of this
34 title, is the sole responsibility of the ((domestic winery)) liquor
35 licensee.
