READ FIRST TIME 02/03/23.
1 AN ACT Relating to authorizing the department of fish and
2 wildlife to establish disease interdiction and control check
3 stations; and adding a new chapter to Title 77 RCW.
4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
5 NEW SECTION. Sec. 1. There are infectious diseases and
6 infestations that can damage, threaten, and endanger fish, wildlife,
7 shellfish, and seaweed resources. The department is authorized to
8 take reasonable, preventative measures to protect Washington's fish,
9 wildlife, shellfish, and seaweed species from infectious diseases and
10 infestations.
11 NEW SECTION. Sec. 2. (1) The department is authorized to
12 establish disease interdiction and control check stations.
13 (2) The check stations may be signed from roadsides, including
14 state highways and interstates.
15 (3) Signage must indicate which diseases or infestations are
16 being investigated, and what fish, wildlife, shellfish, and seaweed
17 are being checked.
18 (4) The signage must be placed in coordination with the
19 department of transportation.
20 (5) The check stations must be operated in a safe manner.

1 (6) A person who encounters a disease interdiction and control
2 check station while transporting fish, wildlife, shellfish, or
3 seaweed in their possession is requested to stop at the check station
4 and allow the fish, wildlife, shellfish, or seaweed in their
5 possession to be inspected and sampled for the diseases or
6 infestations.
7 NEW SECTION. Sec. 3. This chapter does not apply to
8 aquaculture, aquatic farmers, or private sector cultured aquatic
9 products as those terms are defined in RCW 15.85.020.
10 NEW SECTION. Sec. 4. Sections 1 through 3 of this act
11 constitute a new chapter in Title 77 RCW.
