Bill S.300, introduced by Senators Williams and Heffernan, mandates that hospitals licensed in Vermont include fentanyl testing as part of any urine drug screening conducted to assist in diagnosing a patient's condition. The new section 4755 of Title 18 establishes that if a hospital performs a urine drug screening, it must test for fentanyl. Additionally, the bill stipulates that hospitals and their employees are prohibited from disclosing fentanyl screening results to law enforcement unless a valid warrant or subpoena is presented. Furthermore, it provides immunity from civil and criminal liability for hospitals that disclose results in good faith reliance on this provision.

The bill also defines "urine drug screening" as a chemical analysis intended to test for the presence of multiple drugs, including cocaine, opioids, and phencyclidine. The act is set to take effect on July 1, 2026.
