Bill H.645 aims to enhance the verification process for identities involved in real property transactions in Vermont. It establishes a registry of secure real property transactors who utilize an approved identity verification platform to confirm the identities of grantors. Town clerks are required to expedite the indorsement of instruments for recording if the involved parties, such as grantors, grantees, and attorneys, are registered as secure transactors or have used an approved verification platform. If verification cannot be completed, clerks must notify the parties that the instrument will not be recorded until the necessary information is provided or a specified time period has elapsed. Additionally, the Secretary of State will maintain a list of approved identity verification platforms and a registry of secure real property transactors.
The bill also introduces new responsibilities for real estate brokers, salespersons, and attorneys. It mandates that real estate professionals take reasonable steps to verify the identity of their clients, with the option to use an approved identity verification platform. Furthermore, attorneys representing grantors must sign an affidavit confirming they have verified the identity of their clients before executing a deed. The act is set to take effect on January 1, 2027.
