The bill S.173 amends the existing vocational rehabilitation laws in Vermont to enhance the support provided to injured workers. Key changes include the requirement for the Department to provide injured workers with a form that outlines their rights, including the right to request vocational rehabilitation services in the future if their work injury affects their ability to earn their pre-injury wage. Additionally, the bill stipulates that if an employer fails to assign a vocational rehabilitation provider within 90 days of the worker being out of work, the worker may initiate services with their chosen provider. The Commissioner is also tasked with adopting rules to ensure timely referrals to vocational rehabilitation counselors for workers who have been out of work for more than 90 days.
Furthermore, the bill establishes a Vocational Rehabilitation Working Group tasked with providing recommendations to improve the vocational rehabilitation system. This group will consist of various stakeholders, including representatives from workers' compensation claimants, employers, and certified vocational rehabilitation counselors. The Working Group is expected to meet and develop recommendations on how to better identify claimants in need of services, improve access to benefits, and enhance the overall effectiveness and cost-efficiency of the vocational rehabilitation system. A report with findings and recommendations is due by December 15, 2026.
