The bill amends Vermont's existing laws regarding community-based services and payment rates for providers. It introduces a new definition of "community-based services," which includes long-term services and supports for older adults and individuals with disabilities, as well as various health and rehabilitation services provided in non-clinical settings. Additionally, it establishes a new section (33 V.S.A. 911) that mandates the Secretary of Human Services to calculate reasonable and adequate payment rates for these providers, taking into account factors such as governmental mandates, inflation, and regional cost differences. The Secretary is also required to develop a methodology for these calculations, conduct regular studies on Medicaid reimbursement rates, and report annually to relevant legislative committees.

Furthermore, the bill modifies the existing responsibilities of the Secretary of Human Services regarding payment rates for designated and specialized service agencies, aligning them with the new requirements set forth in 33 V.S.A. 911. It also includes a provision for providers at risk of closure to request stabilization assistance from the Agency. An implementation update is required by January 15, 2026, detailing the progress on the new payment rate calculations and the proposed schedule for Medicaid rate studies. The act takes effect upon passage.
