6 Statement of purpose of bill as introduced: This bill proposes to regulate the
7 use of binary explosives, like Tannerite, and other related compounds by
8 classifying such compounds as explosives.
9 An act relating to the regulation of binary explosives and other related
10 compounds
11 It is hereby enacted by the General Assembly of the State of Vermont:
12 Sec. 1. 13 V.S.A. § 1603 is amended to read:
13 § 1603. DEFINITIONS
14 For the purposes of this chapter:
15 (1) “Destructive device” means any:
16 (A) explosive, incendiary, or poison gas bomb; or
17 (B) explosive, incendiary, or poison gas grenade; or
18 (C) explosive, incendiary, or poison gas rocket having a propellant

1 (D) explosive, incendiary, or poison gas missile having an explosive
2 or incendiary charge of more than one-quarter ounce; or
3 (E) explosive, incendiary, or poison gas mine; or
4 (F) device that consists of or includes a breakable container including
5 a flammable liquid or compound, and a wick composed of any material that,
6 when ignited, is capable of igniting the flammable liquid or compound, and
7 can be carried or thrown by one individual acting alone; or
8 (G) device similar to those devices enumerated in subdivisions (1)
9 and (1)(A)–(E) of this section.
10 A destructive device does not include a firearm or ammunition therefor.
11 (2) “Explosive” means:
12 (A) dynamite Dynamite, or any explosive compound of which
13 nitroglycerin forms a part, or fulminate in bulk or dry condition, or blasting
14 caps, or detonating fuses, or blasting powder, or any other similar explosive.
15 The term does not include a firearm or ammunition therefor or any components
16 of ammunition for a firearm including primers, smokeless powder, or black
17 gunpowder.
18 (B) Two or more components that are advertised and sold together
19 with instructions on how to combine the components to create an explosive, as
20 defined in subdivision (A) of this subdivision (2).

1 (3) “Hoax device” means any device so designed, assembled, fabricated,
2 or manufactured as to convey the physical appearance of an explosive or
3 incendiary bomb or the physical appearance of any of the devices enumerated
4 in subdivisions (1)(A)–(F) of this section that is lacking an explosive or
5 incendiary charge.
6 (4) A destructive device does not include a firearm or ammunition for a
7 firearm.
8 Sec. 2. EFFECTIVE DATE
9 This act shall take effect on July 1, 2024.
