6 Statement of purpose of bill as introduced: This bill proposes to require the
7 Agency of Education to maintain an agreement with a virtual learning provider
8 for the purposes of offering virtual learning opportunities to Vermont students
9 as well as set certain criteria required for a student to enroll full time in virtual
10 learning.
11 An act relating to virtual learning
12 It is hereby enacted by the General Assembly of the State of Vermont:
13 Sec. 1. 16 V.S.A. § 948 is added to read:
14 § 948. VIRTUAL LEARNING
15 (a) The Agency of Education shall maintain an agreement with a virtual
16 learning provider for the purpose of offering virtual learning opportunities to
17 Vermont students.
18 (b) A student may enroll in virtual learning full time if:
19 (1) the student is enrolled in a public school;
20 (2) the student is enrolled in a middle or high school program;

1 (3) virtual learning is found to be a beneficial option under the student’s
2 personalized learning plan; and
3 (4) the student’s course of study meets minimum standards under
4 guidance promulgated by the Agency.
5 (c) The Agency of Education may adopt rules pursuant to 3 V.S.A.
6 chapter 25 as necessary to implement this section.
7 (d) A school district shall count a student enrolled in remote learning in the
8 school district’s average daily membership, as defined in section 4001 of this
9 title, if the student meets all of the criteria in subsection (b) of this section.
10 Sec. 2. EFFECTIVE DATE
11 This act shall take effect on July 1, 2024.
