8 Statement of purpose of bill as introduced: This bill proposes to require sellers
9 of residential real estate to disclose to prospective buyers whether a residence
10 has been tested for radon and to provide a copy of any radon testing report.
11 An act relating to requiring radon testing disclosure in residential real estate
12 sales
13 It is hereby enacted by the General Assembly of the State of Vermont:
14 Sec. 1. 27 V.S.A. § 618 is added to read:
15 § 618. DISCLOSURE REQUIRED; RADON TESTING
16 (a) Any person offering to sell residential real estate shall disclose in any
17 contract for purchase or sale of the property whether any residence on the
18 property has been tested for radon and, if a residence has been tested, provide a
19 copy of the radon testing report for the residence.

1 (b) Noncompliance with the requirements of this section shall not affect the
2 marketability of title of a property.
3 Sec. 2. EFFECTIVE DATE
4 This act shall take effect on July 1, 2024.
