12 Statement of purpose of bill as introduced: This bill proposes to impose an
13 occupancy requirement on short-term rental owners.
14 An act relating to short-term rental occupancy requirements
15 It is hereby enacted by the General Assembly of the State of Vermont:
16 Sec. 1. 18 V.S.A. § 4301 is amended to read:
17 § 4301. DEFINITIONS
18 (a) As used in this chapter:

1 (9) “Lodging establishment” means a place where overnight
2 accommodations are regularly provided to the transient, traveling, or
3 vacationing public, including hotels, motels, inns, and bed and breakfasts.
4 “Lodging establishment” shall does not include short-term rentals.

6 (14) “Short-term rental” means all or part of a furnished house,
7 condominium, or other dwelling room or self-contained dwelling unit rented to
8 the transient, traveling, or vacationing public that is:
9 (A) offered to the public for a rental period of fewer than 30
10 consecutive days; and
11 (B) rented for more than 14 days per calendar year.

13 Sec. 2. 18 V.S.A. § 4469 is added to read:
14 § 4469. OCCUPANCY REQUIREMENT
15 A person shall not offer all or part of a dwelling unit as a short-term rental
16 unless the person has occupied the dwelling unit for:
17 (1) 120 days of the preceding year; or
18 (2) if the person has owned or leased the dwelling unit for less than a
19 year, a number of days greater than or equal to 33 percent of the days that the
20 person has owned or leased the dwelling unit rounded down to the nearest
21 whole number.

1 Sec. 3. EFFECTIVE DATE
2 This act shall take effect on July 1, 2024.
