5 Subject: Health; health insurance; advanced practice registered nurse;
6 physician assistant; reimbursement rates
7 Statement of purpose of bill as introduced: This bill proposes to require health
8 insurers to reimburse advanced practice registered nurses and physician
9 assistants at the same rates as physicians for providing the same health care
10 services. It would also direct the Department of Financial Regulation to report
11 on the implementation of the act.
12 An act relating to health insurance reimbursement rate parity
13 It is hereby enacted by the General Assembly of the State of Vermont:
14 Sec. 1. 18 V.S.A. § 9423 is added to read:
15 § 9423. REIMBURSEMENT RATE PARITY ACROSS PROVIDERS
16 (a) As used in this section, “health insurer” has the same meaning as in
17 section 9402 of this title.
18 (b) A health insurer shall not reimburse an advanced practice registered
19 nurse licensed under 26 V.S.A. chapter 28, subchapter 2 or a physician
20 assistant licensed under 26 V.S.A. chapter 31 who is participating in the VT LEG #371837 v.1

1 insurer’s network in an amount less than the amount the insurer would
2 reimburse for the same service if provided by an in-network physician licensed
3 under 26 V.S.A. chapter 23 or 33.
4 (c) A health insurer shall not reduce the reimbursement amount paid to
5 physicians licensed under 26 V.S.A. chapter 23 or 33 in order to comply with
6 this section.
7 Sec. 2. DEPARTMENT OF FINANCIAL REGULATION;
8 REIMBURSEMENT RATE PARITY; REPORT
9 On or before January 15, 2026, the Department of Financial Regulation
10 shall report to the House Committee on Health Care and the Senate
11 Committees on Health and Welfare and on Finance on the implementation of
12 this act, including:
13 (1) the number of health insurers that changed reimbursement rates as a
14 result of this act;
15 (2) the number of advanced practice registered nurses and physician
16 assistants whose reimbursement rates were increased as a result of this act;
17 (3) the number of physicians whose reimbursement rates were decreased
18 as a result of this act; and
19 (4) the costs incurred by each insurer to implement this act.
20 Sec. 3. EFFECTIVE DATE
21 This act shall take effect on January 1, 2025.
