6 Statement of purpose of bill as introduced: This bill proposes to only require a
7 jurisdictional opinion for projects temporarily exempt from Act 250 if the
8 project will not be complete by June 30, 2026.
9 An act relating to requiring a jurisdictional opinion to be exempt from
10 Act 250
11 It is hereby enacted by the General Assembly of the State of Vermont:
12 Sec. 1. Sec. 16a of 2023 Acts and Resolves No. 47 is amended to read:
13 Sec. 16a. ACT 250 EXEMPTION REQUIREMENTS
14 In order to qualify for If construction of a development initiated under the
15 exemptions established in 10 V.S.A. § 6001 (3)(A)(xi) and (3)(D)(viii)(III) will
16 not be completed before June 30, 2026, a person shall request a jurisdictional
17 opinion under 10 V.S.A. § 6007 on or before June 30, 2026. The jurisdictional
18 opinion shall require include a requirement that the project to be substantially
19 complete construction on or before June 30, 2029 in order to remain exempt.

2 This act shall take effect on passage.
