6 Statement of purpose of bill as introduced: This bill proposes to set the
7 compensation levels for the Governor and the heads of departments and
8 agencies at the same level as members of the General Assembly, other than the
9 Speaker of the House and the President Pro Tempore of the Senate.
10 An act relating to compensation for the Governor and the heads of
11 departments and agencies
12 It is hereby enacted by the General Assembly of the State of Vermont:
13 Sec. 1. 32 V.S.A. § 1003 is amended to read:
14 § 1003. STATE OFFICERS
15 (a) Each elective officer of the Executive Department, other than the
16 Governor, is entitled to an annual salary as follows:

6 (b)(1) The Governor may appoint and each officer of the Executive Branch
7 listed in this subsection at a starting salary ranging from the base salary stated
8 for that position to a salary that does not exceed the maximum salary unless
9 otherwise authorized by this subsection. The maximum salary for each
10 appointive officer shall be 50 percent above the base salary. Annually, the
11 Governor may grant to each of those officers an annual salary adjustment
12 subject to the maximum salary. The annual salary adjustment granted to
13 officers under this subsection shall not exceed the average rate of adjustment
14 available to classified employees under the collective bargaining agreement
15 then in effect. In addition to the annual salary adjustment specified in this
16 subsection, the Governor may grant a special salary increase subject to the
17 maximum salary, or a bonus, to any officer listed in this subsection whose job
18 duties have significantly increased, or whose contributions to the State in the
19 preceding year are deemed especially significant. Special salary increases or
20 bonuses granted to any individual shall not exceed the average rate of
21 adjustment available to classified employees under the collective bargaining VT LEG #371726 v.1

1 agreement then in effect. are entitled to the same weekly salary as each
2 member of the General Assembly, other than the Speaker of the House and the
3 President Pro Tempore of the Senate, as described in subdivision 1052(a)(1) of
4 this title, except that salaries may be paid during times outside of the Biennial
5 Session and only for time actually worked, to be calculated proportional to a
6 40-hour work week but not to exceed the weekly salary described in
7 subdivision 1052(a)(1) of this title.

12 (3) If the Chair of the Natural Resources Board is employed on less than
13 a full-time basis, the hiring and salary maximums for that position shall be
14 reduced proportionately. [Repealed.]
15 (4) When a permanent employee is appointed to an exempt position, the
16 Governor may authorize such employee to retain the present salary even
17 though it is in excess of any salary maximum provided in statute. [Repealed.]
18 (c) The officers of the Judicial Branch named in this subsection shall be
19 entitled to annual salaries as follows:

15 (e) Notwithstanding the maximum salary established in subsection (b) of
16 this section, the maximum salary for the Commissioner of Health shall not
17 exceed 100 percent above the base salary for this position. [Repealed.]
18 Sec. 2. EFFECTIVE DATE
19 This act shall take effect on passage.
