5 Subject: Labor; unemployment insurance; work search; overpayment of
6 benefits
7 Statement of purpose of bill as introduced: This bill proposes to require
8 individuals to repay any unemployment insurance benefits received during a
9 week in which the individual failed to conduct an interview for suitable work
10 or provided an employer with false or inaccurate information that prevented
11 the employer from scheduling an interview with the individual.
12 An act relating to work search requirements for individuals receiving
13 unemployment insurance benefits
14 It is hereby enacted by the General Assembly of the State of Vermont:
15 Sec. 1. 21 V.S.A. § 1347 is amended to read:
16 § 1347. NONDISCLOSURE OR MISREPRESENTATION
17 (a)(1) Any person who fails, without good cause, to make reasonable effort
18 to secure suitable work when directed to do so by the employment office or the
19 Commissioner and has received any amount as benefits under this chapter with
20 respect to weeks for which the person is determined to be ineligible for such VT LEG #372905 v.1

1 failure, and any person who by nondisclosure or misrepresentation by him or
2 her the person, or by another, of a material fact (irrespective of whether such
3 the nondisclosure or misrepresentation was known or fraudulent) has received
4 any amount as benefits under this chapter while any conditions for the receipt
5 of benefits imposed by this chapter were not fulfilled in his or her the person’s
6 case or while he or she the person was disqualified from receiving benefits,
7 shall be liable for such the amount.
8 (2) A person shall be deemed to have failed to make reasonable efforts
9 to secure suitable work if the person:
10 (A) fails, without good cause, to conduct an interview for suitable
11 work after an employer has contacted the person to arrange such an interview;
12 or
13 (B) provides false or inaccurate information to an employer that
14 prevents the employer from contacting the person to arrange an interview for
15 suitable work.
16 (3) Notice of determination in such cases shall specify that the person is
17 liable to repay to the Fund the amount of overpaid benefits, the basis of the
18 overpayment, and the week or weeks for which such the benefits were paid.
19 The determination shall be made within three years from the date of such the
20 overpayment.

1 Sec. 2. EFFECTIVE DATE
2 This act shall take effect on July 1, 2024.
