5 Subject: Alcoholic beverages; licensing; first-, second-, and third-class
6 licenses; use of contiguous premises
7 Statement of purpose of bill as introduced: This bill proposes to allow the
8 holder of any combination of first-, second-, and third-class licenses to sell
9 closed containers of alcoholic beverages, for off-premises consumption,
10 anywhere in first- or third-class licensed premises.
11 An act relating to the sale of closed containers of alcoholic beverages within
12 a first- or third-class license serving area
13 It is hereby enacted by the General Assembly of the State of Vermont:
14 Sec. 1. 7 V.S.A. § 221 is amended to read:
15 § 221. FIRST-CLASS LICENSES

17 (b)(1) A first-class license permits the holder to sell malt beverages, vinous
18 beverages, and ready-to-drink spirits beverages for consumption only on those
19 premises. This subsection shall not be construed to prohibit the holder of both

1 same contiguous premises. The holder of a first- and second-class license may
2 sell alcoholic beverages, for off-premises consumption, anywhere on the first-
3 class licensed premises.

5 Sec. 2. 7 V.S.A. § 223 is amended to read:
6 § 223. THIRD-CLASS LICENSES

8 (b) A third-class license holder may sell spirits and fortified wines for
9 consumption only on the licensed premises, boat, or railroad dining car. This
10 subsection shall not be construed to prohibit the holder of both a second- and
11 third-class license from operating both licenses from within the same
12 contiguous premises. The holder of a second- and third-class license may sell
13 alcoholic beverages, for off-premises consumption, anywhere on the third-
14 class licensed premises.

16 Sec. 3. EFFECTIVE DATE
17 This act shall take effect on July 1, 2024.
