5 Subject: Conservation and development; solid waste; plastics; regulated
6 technologies
7 Statement of purpose of bill as introduced: This bill proposes to prohibit the
8 construction or operation of any new facility that uses plastic in a regulated
9 technology, such as energy generation, pyrolysis, or combustion. The bill also
10 would ban any State incentive for a regulated technology that uses plastics.
11 An act relating to prohibiting the use of plastics in certain technologies
12 It is hereby enacted by the General Assembly of the State of Vermont:
13 Sec. 1. 10 V.S.A. chapter 159, subchapter 6 is added to read:
14 Subchapter 6. Use of Plastics in Regulated Technologies
15 § 6721. DEFINITIONS
16 As used in this subchapter:
17 (1) “Facility” means any structure, place, amenity, equipment, tool, or
18 operation built, installed, or established for the purpose of performing,
19 facilitating, aiding, or otherwise using regulated technologies for plastics.

1 (2) “Person” means any natural person as well as any corporation,
2 company, partnership, firm, society, or association of persons.
3 (3) “Plastics” means polymers that are solid and do not meet any of the
4 following conditions:
5 (A) polymers that are the result of a polymerization process that has
6 taken place in nature, independently of the process through which they have
7 been extracted, that are not chemically modified substances; or
8 (B) polymers that do not contain carbon atoms in their chemical
9 structure.
10 (4) “Recycling” means any process in which materials are collected,
11 separated, or processed and returned to the marketplace in the form of raw
12 materials to make new products. “Recycling” does not include regulated
13 technologies for plastics.
14 (5) “Regulated technologies” means, with regard to plastics;
15 (A) the use of plastic for energy generation, for fuel production, or as
16 a fuel; or
17 (B) the following processes:
18 (i) gasification;
19 (ii) pyrolysis;
20 (iii) solvolysis;
21 (iv) hydropyrolysis;

1 (v) methanolysis;
2 (vi) combustion; or
3 (vii) any other process used to transform plastic or plastic-derived
4 materials into plastic monomers, chemicals, waxes, lubricants, chemical
5 feedstocks, crude oil, diesel, gasoline, aviation fuel, or home heating oil.
6 § 6722. REGULATED TECHNOLOGIES FACILITIES; PROHIBITION
7 (a) A person may not build, construct, establish, or operate any new or
8 expanded facility that uses regulated technologies for plastics in the State. The
9 prohibition in this subsection includes the modification or conversion of any
10 existing noncovered facilities in the State into facilities that use regulated
11 technologies for plastics.
12 (b) The State shall not provide subsidies, grants, loans, tax credits, tax
13 breaks, or any other financial or nonfinancial incentive to support the
14 development of a facility that uses regulated technologies for plastics or
15 programs focused on regulated technologies for plastics. The use of regulated
16 technologies for plastics shall not be considered recycling for purposes of any
17 program established or employed in the State.
18 (c) The use of regulated technologies for plastics or the use or combustion
19 of the products they produce shall not be considered “renewable energy,”
20 “clean energy,” “green energy,” “climate-friendly,” “biofuels,” “zero-carbon,”
21 or any similar category for State programs.

1 (d) The Secretary may adopt rules to implement the requirements of this
2 subchapter.
3 Sec. 2. EFFECTIVE DATE
4 This act shall take effect on July 1, 2025.
