7 Statement of purpose of bill as introduced: This bill proposes to direct the
8 Department of Public Safety to provide legal assistance to the Access Board
9 for purposes of rulemaking.
10 An act relating to providing legal assistance to the Access Board
11 It is hereby enacted by the General Assembly of the State of Vermont:
12 Sec. 1. 20 V.S.A. § 2901 is amended to read:
13 § 2901. ACCESS BOARD
14 (a) An access board The Access Board is created consisting and shall
15 consist of ten 10 members. The members of the board Board shall be the
16 Commissioner of Public Safety or designee; the Chair of the House Committee
17 on Corrections and Institutions or designee; the Chair of the Senate Committee
18 on Institutions or designee; the Commissioner of Buildings and General
19 Services or designee; the State Historic Preservation Officer or designee; and
20 five members appointed by the Governor, including an independent architect, a VT LEG #372880 v.1

1 builder or contractor, and three individuals with disabilities representing
2 organizations for persons with disabilities in this State, appointed by the
3 Governor. The Governor shall also appoint one additional individual with a
4 disability to act as an alternate for the three members with disabilities in the
5 event one of those members is unable to attend a Board meeting. The alternate
6 may attend all meetings and shall be paid a per diem for those meetings
7 attended. The alternate shall vote only in the absence of an appointed member
8 with a disability. Members and the alternate appointed by the Governor shall
9 serve for a term of six years.

11 (c) The Access Board may adopt, amend, and repeal rules under 3 V.S.A.
12 chapter 25 to carry out the provisions of this chapter.
13 (d) For purposes of adopting, amending, and repealing rules pursuant to the
14 provisions of this chapter, the Access Board shall have the legal assistance of
15 the Department of Public Safety.
16 Sec. 2. EFFECTIVE DATE
17 This act shall take effect on passage.
