7 Statement of purpose of bill as introduced: This bill proposes to amend the
8 requisite intent for operating a motor vehicle without consent of the owner.
9 An act relating to operating a motor vehicle without consent of the owner
10 It is hereby enacted by the General Assembly of the State of Vermont:
11 Sec. 1. 23 V.S.A. § 1094 is amended to read:
12 § 1094. OPERATION WITHOUT CONSENT OF OWNER;
13 AGGRAVATED OPERATION WITHOUT CONSENT OF OWNER
14 (a) A person commits the crime of operation without consent of the owner
15 if:
16 (1) the person, without the consent of the owner, knowingly takes,
17 obtains, operates, uses, or continues to operate the motor vehicle of another; or
18 (2) the person consciously ignored that the person did not have the
19 consent of the owner when the person took, operated, used, or continued to
20 operate the motor vehicle of another.

2 (c) A person convicted under subsection (a) of this section of operation
3 without consent of the owner shall be imprisoned not more than two years or
4 fined not more than $1,000.00, or both.

6 Sec. 2. EFFECTIVE DATE
7 This act shall take effect on passage.
