Act No. 128 (H.534). An act relating to retail theft
Subjects: Crimes; retail theft
This act modifies the penalties for the crime of retail theft. If the amount of
merchandise stolen is $250.00 or less, the offender may be imprisoned for not more than
30 days. If the amount of merchandise stolen is greater than $250.00 but not more than
$900.00, the offender may be imprisoned for not more than six months for a first offense,
not more than two years for a second offense, not more than three years for a third
offense, or not more than 10 years for a fourth or subsequent offense. If the amount of
merchandise stolen is greater than $900.00, the offender may be imprisoned for not more
than 10 years.
