6 Subject: Motor vehicles; Periodic Inspection Manual; rulemaking
7 Statement of purpose of bill as introduced: This bill proposes to require the
8 Commissioner of Motor Vehicles to—consistent with 23 V.S.A. § 1222(b) and
9 the directive in 2018 Acts and Resolves No. 158, Secs. 41 and 42, and 2018
10 Acts and Resolves No. 206, Secs. 22 and 23, that “the scope of the safety
11 inspection of a motor vehicle . . . shall be limited to parts or systems that are
12 relevant to the vehicle’s safe operation, and such vehicles shall not fail the
13 safety portion of the inspection unless the condition of the part or system poses
14 or may pose a danger to the operator or to other highway users”—update the
15 Periodic Inspection Manual through rulemaking pursuant to 3 V.S.A. chapter
16 25 so that the Periodic Inspection Manual is simplified, consistent with the
17 inspection requirements of states bordering Vermont, exclusively focused on
18 fail criteria related to dangers to the operator or to other highway users, and
19 allows for repair work to be done on a motor vehicle that might otherwise fail
20 inspection provided that the repair work does not jeopardize the structure of
