10 Statement of purpose of bill as introduced: This bill proposes to decriminalize
11 some chemical compounds found in plants and fungi that are commonly used
12 for medicinal, spiritual, religious, or entheogenic purposes.
13 An act relating to decriminalizing certain chemical compounds found in
14 plants and fungi that are commonly used for medicinal, spiritual, religious,
15 or entheogenic purposes
16 It is hereby enacted by the General Assembly of the State of Vermont:
17 Sec. 1. 18 V.S.A. § 4201 is amended to read:
18 § 4201. DEFINITIONS
19 As used in this chapter, unless the context otherwise requires:

1 (10) “Hallucinogenic drugs” means stramonium, mescaline or peyote,
2 lysergic acid diethylamide, and psilocybin, and all synthetic equivalents of
3 chemicals contained in resinous extractives of Cannabis sativa, or any salts or
4 derivatives or compounds of any preparations or mixtures thereof, and any
5 other substance that is designated as habit-forming habit forming or as having
6 a serious potential for abuse arising out of its effect on the central nervous
7 system or its hallucinogenic effect in the rules adopted by the Board of Health
8 under section 4202 of this title.

10 (29)(A) “Regulated drug” means:
11 (A)(i) a narcotic drug;
12 (B)(ii) a depressant or stimulant drug, other than methamphetamine;
13 (C)(iii) a hallucinogenic drug;
14 (D)(iv) Ecstasy;
15 (E)(v) cannabis; or
16 (F)(vi) methamphetamine.
17 (B) “Regulated drug” does not mean the following:
18 (i) peyote;
19 (ii) ayahuasca;
20 (iii) mescaline;
21 (iv) psilocybin or psilocin;

1 (v) ibogaine;
2 (vi) N,N-dimethyltryptamine; or
3 (vii) any plants or fungi containing the substances listed in
4 subdivisions (iii)–(vi) of this subdivision (B).

6 Sec. 2. EFFECTIVE DATE
7 This act shall take effect on July 1, 2023.
