9 Statement of purpose of bill as introduced: This bill proposes to require the
10 Agency of Administration to establish mileage reimbursement rates for plug-in
11 electric vehicles and to allow State employees, public sector employees,
12 members of the General Assembly, and members of boards and commissions
13 who operate a plug-in electric vehicle to choose to be reimbursed at the
14 applicable mileage reimbursement rate for plug-in electric vehicles or at the
15 mileage reimbursement rate for non-plug-in electric vehicles.

1 It is hereby enacted by the General Assembly of the State of Vermont:
2 * * * State Employee Travel and Expense Policy * * *
3 Sec. 1. UPDATE TO THE STATE EMPLOYEE TRAVEL AND EXPENSE
4 POLICY
5 The Secretary of Administration shall update the Employee Travel and
6 Expense Policy (Bulletin No. 3.4) to be effective July 1, 2024 to:
7 (1) include mileage reimbursement rates for plug-in electric vehicles,
8 including plug-in hybrid electric vehicles and battery electric vehicles as
9 defined in 23 V.S.A. § 4(85), which may be independently established and
10 adjusted on a regular basis or set at a percentage of the federal mileage
11 reimbursement rate established by the General Services Administration;
12 (2) allow for State employees to choose whether to be reimbursed at one
13 of the mileage reimbursement rates for plug-in electric vehicles, as applicable,
14 or the mileage reimbursement rate available non-plug-in electric vehicles; and
15 (3) maintain the same requirements for when a State employee can
16 choose to operate a privately owned vehicle and receive a full mileage
17 reimbursement rate without regard to whether or not the privately owned
18 vehicle is a plug-in electric vehicle.

2 Sec. 2. 2 V.S.A. § 23 is amended to read:
3 § 23. STANDING COMMITTEES; AUTHORITY TO MEET; OUT-OF-
4 STATE BUSINESS
5 (a) During adjournment of the General Assembly, any standing committee
6 or subcommittee of a standing committee may with the appropriate approval of
7 the Speaker or the President Pro Tempore meet at the call of its chair to
8 conduct legislative business within the State. For attendance at such a meeting
9 or for attendance at a meeting of a special committee or joint committee, a
10 committee member shall be entitled to per diem compensation and expense
11 reimbursement as follows:

13 (2) actual mileage traveled at the rate rates paid State employees, with a
14 member who operates a plug-in electric vehicle, as defined in 23 V.S.A.
15 § 4(85), having the choice of the mileage reimbursement rate available for the
16 type of plug-in electric vehicle that the member operates or the mileage
17 reimbursement rate available for non-plug-in electric vehicles;

19 Sec. 3. 32 V.S.A. § 1052 is amended to read:
20 § 1052. MEMBERS OF THE GENERAL ASSEMBLY; COMPENSATION
21 AND EXPENSE REIMBURSEMENT

2 (b) During any session of the General Assembly, each member is entitled
3 to receive expenses as follows:
4 (1) Mileage reimbursement. Reimbursement equal to the actual mileage
5 traveled for each day of session in which the member travels between
6 Montpelier and the member’s home or from Montpelier or from the member’s
7 home to another site on officially sanctioned legislative business.
8 Reimbursement of actual mileage traveled under this subdivision shall be at the
9 rate per mile determined by the federal Office of Government-wide Policy and
10 published in the Federal Register for the year of the session rates paid State
11 employees, with a member who operates a plug-in electric vehicle, as defined
12 in 23 V.S.A. § 4(85), having the choice of the mileage reimbursement rate
13 available for the type of plug-in electric vehicle that the member operates or
14 the mileage reimbursement rate available for non-plug-in electric vehicles.

17 Sec. 4. 32 V.S.A. § 1010(c) is amended to read:
18 (c)(1) The members of the boards and commissions, including those
19 members serving ex officio or otherwise regularly employed by the State, shall
20 be entitled to receive their actual and necessary expenses when away from
21 home or office upon their official duties.

1 (2) Mileage reimbursement shall be at the rates paid State employees,
2 with a member who operates a plug-in electric vehicle, as defined in 23 V.S.A.
3 § 4(85), having the choice of the mileage reimbursement rate available for the
4 type of plug-in electric vehicle that the member operates or the mileage
5 reimbursement rate available for non-plug-in electric vehicles.

8 Sec. 5. MILEAGE REIMBURSEMENT RATES UNDER COLLECTIVE
9 BARGAINING AGREEMENTS
10 (a) The mileage reimbursement rates for plug-in electric vehicles, including
11 plug-in hybrid electric vehicles and battery electric vehicles as defined in 23
12 V.S.A. § 4(85), shall be the subject of collective bargaining between the State
13 and the collective bargaining representative of each bargaining unit of State
14 employees and shall be addressed in the collective bargaining agreement for
15 each bargaining unit.
16 (b) The mileage reimbursement rates for plug-in electric vehicles
17 established in each collective bargaining agreement pursuant to subsection (a)
18 of this section:
19 (1) may be independently established and adjusted on a regular basis or
20 set at a percentage of the federal mileage reimbursement rate established by the

1 (2) shall be optional with any State employee subject to a collective
2 bargaining agreement permitted to choose whether to be reimbursed at one of
3 the mileage reimbursement rates for plug-in electric vehicles, as applicable, or
4 the mileage reimbursement rate available for non-plug-in electric vehicles.

6 Sec. 6. EFFECTIVE DATES
7 (a) This section and Sec. 1 (update to the State Employee Travel and
8 Expense Policy) shall take effect on passage.
9 (b) Secs. 2 and 3 (members of the General Assembly; 2 V.S.A. § 23 and
10 32 V.S.A. § 1052) and 4 (members of boards and commissions; 32 V.S.A.
11 § 1010) shall take effect on July 1, 2024.
12 (c) Sec. 5 (mileage reimbursement rates under collective bargaining
13 agreements) shall take effect on passage and shall apply to collective
14 bargaining agreements between the State and any labor organizations
15 representing State employees that take effect on or after July 1, 2024.
