9 Statement of purpose of bill as introduced: This bill proposes to prohibit the
10 sale, offer for sale, or distribution of a consumer product in the State that has a
11 total organic fluorine concentration of greater than 100 parts per million.
12 An act relating to prohibiting the labeling of consumer products that contain
13 PFAS as compostable
14 It is hereby enacted by the General Assembly of the State of Vermont:
15 Sec. 1. 10 V.S.A. § 6621 is added to read:
16 § 6621. LABELING OF CONSUMER PRODUCTS AS COMPOSTABLE
17 (a) As used in this section:
18 (1) “Consumer product” means:
19 (A) any product that is regularly used or purchased to be used for
20 personal, family, or household purposes;

1 (B) a package or packaging component; or
2 (C) a bag, sack, wrap, or plastic sheet.
3 (2) “Package” means a container providing a means of marketing,
4 protecting, or handling a product and includes a unit package, an intermediate
5 package, and a shipping container.
6 (3) “Packaging component” means an individual assembled part of a
7 package, such as any interior or exterior blocking, bracing, cushioning,
8 weatherproofing, exterior strapping, coatings, closures, inks, and labels, and
9 disposable gloves used in commercial or institutional food service.
10 (4) “Perfluoroalkyl and polyfluoroalkyl substances” or “PFAS” has the
11 same meaning as in 18 V.S.A. § 1661.
12 (b) A person shall not sell, offer for sale, or distribute in the State a
13 consumer product that is labeled with the term compostable if the product has a
14 total organic fluorine concentration of greater than 100 parts per million or
15 exceeds a standard established by the Secretary of Natural Resources by rule.
16 (c) The Secretary of Natural Resources may adopt rules under this chapter
17 to establish total organic fluorine concentrations or PFAS concentrations in
18 consumer products that are more strict than the standard established under
19 subsection (b) of this section.
20 Sec. 2. EFFECTIVE DATE
21 This act shall take effect on passage.
