Act No. 100 (H.40). An act relating to nonconsensual removal of or tampering with a
condom
Subjects: Sexual assault; nonconsensual removal of or tampering with a sexually
protective device
This act establishes a private civil right of action if a person intentionally and without
consent removed or tampered with a condom prior to or during a sexual act in a manner
likely to render it ineffective when consent to the sexual act was given by the other
person with the explicit understanding that a condom would be used. A person who is
harmed may sue for compensatory damages, punitive damages, and reasonable costs and
attorney’s fees.
