6 Statement of purpose of bill as introduced: This bill proposes to prohibit a law
7 enforcement officer from engaging in a sexual act with a person whom the
8 officer is investigating or who the officer knows is being investigated by
9 another officer.
10 An act relating to sexual exploitation of a person who is being investigated
11 by law enforcement
12 It is hereby enacted by the General Assembly of the State of Vermont:
13 Sec. 1. 13 V.S.A. § 3259 is amended to read:
14 § 3259. SEXUAL EXPLOITATION OF A PERSON WHO IS BEING
15 INVESTIGATED, DETAINED, ARRESTED, OR IN THE
16 CUSTODY OF A LAW ENFORCEMENT OFFICER
17 (a) No law enforcement officer shall engage in a sexual act with a person
18 whom the officer is investigating, detaining, arresting, or otherwise holding in
19 custody or who the officer knows is being investigated, detained, arrested, or
20 otherwise held in custody by another law enforcement officer. For purposes of

1 this section “detaining” and “detained” shall include a traffic stop or
2 questioning pursuant to an investigation of a crime.
3 (b) A person who violates subsection (a) of this section shall be imprisoned
4 for not more than five years or fined not more than $10,000.00, or both.
5 Sec. 2. EFFECTIVE DATE
6 This act shall take effect on passage.
