7 LONG TITLE
8 General Description:
9 This bill supplements or reduces appropriations otherwise provided for the support and
10 operation of state government for the fiscal year beginning July 1, 2023 and ending June 30, 2024.
11 Highlighted Provisions:
12 This bill:
13 < provides appropriations for the use and support of higher education and certain state
14 agencies;
15 < authorizes full time employment levels for certain internal service funds;
16 < provides appropriations for other purposes as described; and
17 < provides intent language.
18 Money Appropriated in this Bill:
19 This bill appropriates $481,530,000 in operating and capital budgets for fiscal year 2024,
20 including:
21 < ($1,062,700) from the General Fund;
22 < $1,506,300 from the Income Tax Fund; and
23 < $481,086,400 from various sources as detailed in this bill.
24 This bill appropriates ($69,598,700) in expendable funds and accounts for fiscal year 2024,
25 including:
26 < $1,099,600 from the General Fund; and
27 < ($70,698,300) from various sources as detailed in this bill.
28 This bill appropriates $155,607,200 in business-like activities for fiscal year 2024, including:
29 < $5,499,400 from the General Fund; and
30 < $150,107,800 from various sources as detailed in this bill.
31 This bill appropriates ($18,185,400) in restricted fund and account transfers for fiscal year
32 2024, including:
33 < ($1,239,900) from the General Fund;
34 < ($12,648,000) from the Income Tax Fund; and

35 < ($4,297,500) from various sources as detailed in this bill.
36 This bill appropriates $63,790,900 in transfers to unrestricted funds for fiscal year 2024.
37 This bill appropriates ($31,105,600) in capital project funds for fiscal year 2024, including:
38 < ($16,815,000) from the Income Tax Fund; and
39 < ($14,290,600) from various sources as detailed in this bill.
40 Other Special Clauses:
41 This bill takes effect immediately.

45 Be it enacted by the Legislature of the state of Utah:
46 Section 1. FY 2024 Appropriations. The following sums of money are appropriated for the
47 fiscal year beginning July 1, 2023 and ending June 30, 2024. These are additions to amounts
48 otherwise appropriated for fiscal year 2024.
49 Subsection 1(a). Operating and Capital Budgets. Under the terms and conditions of
50 Title 63J, Chapter 1, Budgetary Procedures Act, the Legislature appropriates the following sums of
51 money from the funds or accounts indicated for the use and support of the government of the state of
52 Utah.
53 EXECUTIVE OFFICES AND CRIMINAL JUSTICE
54 ATTORNEY GENERAL
55 ITEM 1 To Attorney General
56 The Legislature intends that the Attorney General's Office,
57 Medicaid Fraud Division, purchase two (2) additional vehicles
58 for investigators with division funds approved during the 2024
59 General Session of Legislature.
60 The Legislature intends that the Attorney General's Office,
61 Medicaid Fraud Division, purchase one additional vehicle for
62 investigators in Fiscal Year 2024 with division funds approved
63 during the 2023 General Session of the Legislature.
64 Under Section 63-J-1-603 of the Utah Code, the Legislature
65 intends that up to $3,000,000 in appropriations to the Attorney
66 General's Office in Item 1 of Chapter 468, Laws of Utah 2023,
67 not to lapse at the close of Fiscal Year 2024. The use of any
68 unused funds is limited to purchase of hardware and software,
69 program development and operational costs, facility upgrades,
70 pass-through funds appropriated by the Legislature, and other
71 one-time operational and capital expenses.

77 Under Section 63-J-1-603 of the Utah Code, the Legislature
78 intends that up to $6,133,400 in appropriations to the
79 Children's Justice Centers Item 152 of Chapter 468, Laws of
80 Utah 2023, not to lapse at the close of Fiscal Year 2024. The
81 use of any unused funds is limited to costs passed through to
82 operate the local centers or for one-time operational costs.
83 ITEM 3 To Attorney General - Contract Attorneys
84 The Legislature intends that the Attorney General's Office
85 be authorized to use up to $1,151,500 appropriated previously
86 in the Contract Attorneys line item for Commerce Clause Legal
87 Challenge for other purposes in the same line item.
88 Under Section 63-J-1-603 of the Utah Code, the Legislature
89 intends that up to $6,000,000 in appropriations to the Attorney
90 General - Contract Attorneys, Item 3 of Chapter 468, Laws of
91 Utah 2023, not to lapse at the close of Fiscal Year 2024. The
92 use of any unused funds is limited to payment of costs
93 associated with the Chevron Doctrine litigation, the Utah
94 Monuments litigation, and other civil litigation.
95 ITEM 4 To Attorney General - Prosecution Council

103 Prosecution Council, Item 4 of Chapter 468, Laws of Utah
104 2023, not to lapse at the close of Fiscal Year 2024. The use of
105 any unused funds is limited to training and technical assistance
106 to prosecutors.

112 Under Section 63J-1-603 of the Utah Code, the Legislature
113 intends that appropriations of up to $1,500,000 provided for the
114 Board of Pardons and Parole in Item 51 of Chapter 9 Laws of
115 Utah 2023 not lapse at the close of Fiscal Year 2024. The use
116 of any nonlapsing funds shall be limited to capital
117 improvements, hearing audio-visual infrastructure, one-time
118 technology or research projects, public outreach and
119 transparency initiative, electronic records and systems,
120 employee incentives and training, contract costs associated
121 with defense counsel for offenders, or offender evaluations.

134 52 of chapter 9, Laws of Utah 2023 not lapse at the close of
135 Fiscal Year 2024. The use of any unused funds is limited to the
136 purchase of the following items: stab and ballistic vests,
137 uniforms, radio supplies and equipment, authorized vehicle
138 purchases, inmate support and food costs, inmate
139 programming/treatment, firearms and ammunition, computer
140 equipment/software and support, equipment and supplies,
141 employee training and development, building and office
142 maintenance/remodeling, furniture, officer recruitment and
143 special projects.
144 The Legislature intends that, within existing funds the
145 Department of Corrections be granted the authority to purchase

146 one vehicle for the AP&P Deputy Director, one vehicle for
147 each investigations staff member, one vehicle for each K9 dog
148 handler, additional vehicles for the CIRT response team
149 expanded operations, additional vehicles for UDC
150 Administration, additional vehicles for the background
151 investigation team, additional vehicles for AP&P
152 agents/supervisors, and additional vehicles for efficiencies &
153 inmate transports with existing department funds.
154 ITEM 7 To Utah Department of Corrections - Jail Contracting
155 Under Section 63J-1-603 of the Utah Code, the Legislature
156 intends that appropriations of up to $5,000,000 for the Utah
157 Department of Corrections - Jail Contracting in item 54 of
158 chapter 9, Laws of Utah 2023 not lapse at the close of Fiscal
159 Year 2024. The use of any funds is limited to housing
160 additional inmates, and treatment and vocational programming
161 for inmates housed at the county jails.

171 Under Sections 63J-1-603 and 63J-1-602.1(62) of the Utah
172 Code, the Legislature intends that any unspent funds remaining
173 in the Juvenile Courts (Budget Line BAAA, Appropriation
174 Code BAE) shall not lapse at the close of Fiscal Year 2024.
175 Unused funds are to be used for Juvenile Courts.
176 Under Section 63J-1-603(3) of the Utah Code, the
177 Legislature intends that appropriations of up to $3,225,000
178 provided to the Judicial Council/State Court Administrator -
179 Administration in Laws of Utah 2023 Chapter 9, Item 55, shall
180 not lapse at the close of Fiscal Year 2024. The use of any
181 unused funds is limited to market comparability salary
182 adjustments and career track advancement; employee retention,

183 training, education assistance, and incentives; translation and
184 interpreter services; IT programming and contracted support;
185 computer equipment and software; courts security; special
186 projects and studies; temporary employees (law clerks); trial
187 court program support and senior judge assistance; grant
188 match; furniture and repairs; purchase of Utah code and rules
189 for judges; and Wellness Council carryforward.
190 ITEM 9 To Judicial Council/State Court Administrator - Contracts and
191 Leases
192 Under Section 63J-1-603 of the Utah Code, the Legislature
193 intends that appropriations of up to $500,000 provided to the
194 Judicial Council/State Court Administrator-Contracts and
195 Leases in Laws of Utah 2023 Chapter 9, Item 56 shall not lapse
196 at the close of Fiscal Year 2024. The use of any non-lapsing
197 funds is limited to lease cost increases, contractual obligations
198 and support.
199 ITEM 10 To Judicial Council/State Court Administrator - Grand Jury
200 Under Section 63J-1-603 of the Utah Code, the Legislature
201 intends that the appropriations of up to $800 provided to the
202 Judicial Council/State Court Administrator-Grand Jury in Laws
203 of Utah 2023 Chapter 9, Item 57 shall not lapse at the close of
204 Fiscal Year 2024. The use of any nonlapsing funds is limited to
205 expenses related to the grand jury.
206 ITEM 11 To Judicial Council/State Court Administrator - Guardian ad Litem

233 fiscal year 2024. The Legislature also intends that dedicated
234 credits that have not been expended shall also not lapse at the
235 close of fiscal year 2024. The use of any unused funds is
236 limited to employee incentives, one-time remodeling costs,
237 equipment purchases, one-time DTS projects, research and
238 development contract extradition costs, meeting and travel
239 costs, state pass through grant programs, legal costs associated
240 with deliberations required for judicial retention elections and
