7 LONG TITLE
8 General Description:
9 This bill modifies provisions related to the Federalism Commission.
10 Highlighted Provisions:
11 This bill:
12 < defines terms;
13 < increases the membership of the Federalism Commission;
14 < authorizes the Legislative Management Committee to appoint nonvoting members
15 to the Federalism Commission;
16 < authorizes the Federalism Commission to approve a certain number of priority
17 requests each Legislative interim to be drafted in the same order of priority as
18 committee bill files; and
19 < makes technical changes.

28 Be it enacted by the Legislature of the state of Utah:
29 Section 1. Section 63C-4a-302 is amended to read:
30 63C-4a-302. Creation of Federalism Commission -- Membership -- Meetings --
31 Staff -- Expenses -- Approval of priority request to receive treatment as committee bill
32 file.
33 (1) (a) There is created the Federalism Commission, comprised of the following [nine]
34 11 voting members:
35 [(a)] (i) the president of the Senate or the president of the Senate's designee who shall
36 serve as cochair of the commission;
37 [(b)] (ii) [two] three other members of the Senate, appointed by the president of the
38 Senate;
39 [(c)] (iii) the speaker of the House or the speaker of the House's designee who shall
40 serve as cochair of the commission;
41 [(d)] (iv) [three] four other members of the House, appointed by the speaker of the
42 House;
43 [(e)] (v) the minority leader of the Senate or the minority leader of the Senate's
44 designee; and
45 [(f)] (vi) the minority leader of the House or the minority leader of the House's
46 designee.
47 (b) (i) Subject to the provisions of this Subsection (1)(b), the Legislative Management
48 Committee may appoint nonvoting members to the commission from a list of individuals
49 recommended by the cochairs of the commission.
50 (ii) If the Legislative Management Committee chooses to not appoint an individual on
51 the list described in Subsection (1)(b)(i), the Legislative Management Committee may ask the
52 cochairs of the commission to submit an additional list of recommendations.
53 (iii) The Legislative Management Committee may not appoint an individual who is not
54 recommended by the cochairs of the commission.
55 (iv) The nonvoting members appointed by the Legislative Management Committee
56 under this Subsection (1)(b) shall be appointed or reappointed for a two-year term.

57 (v) When a vacancy of a nonvoting member occurs for any reason, the Legislative
58 Management Committee, in consultation with the cochairs of the commission, shall appoint a
59 replacement for the unexpired term.
60 (2) (a) A majority of the voting members of the commission constitute a quorum of the
61 commission.
62 (b) Action by a majority of the members of a quorum constitutes action by the
63 commission.
64 (3) The commission may meet up to nine times each year, unless additional meetings
65 are approved by the Legislative Management Committee.
66 (4) The Office of Legislative Research and General Counsel shall provide staff support
67 to the commission.
68 (5) Compensation and expenses of a member of the commission who is a legislator are
69 governed by Section 36-2-2 and Legislative Joint Rules, Title 5, Legislative Compensation and
70 Expenses.
71 (6) Nothing in this section prohibits the commission from closing a meeting under
72 Title 52, Chapter 4, Open and Public Meetings Act, or prohibits the commission from
73 complying with Title 63G, Chapter 2, Government Records Access and Management Act.
74 (7) The commission may, in the commission's discretion, elect to succeed to the
75 position of any of the following under a contract that any of the following are party to, subject
76 to applicable contractual provisions:
77 (a) the Commission on Federalism;
78 (b) the Commission for the Stewardship of Public Lands; and
79 (c) the Federal Funds Commission.
80 (8) (a) As used in this Subsection (8):
81 (i) "Committee bill file" means the same as that term is defined in Legislative Joint
82 Rule JR7-1-101.
83 (ii) "Priority request" means a request for legislation that is prioritized by a legislator
84 under Legislative Joint Rule JR4-2-102.
85 (b) During each Legislative interim, the commission may approve up to three priority
86 requests related to the commission's duties that the Office of Legislative Research and General
87 Counsel drafts in the same order of priority as a committee bill file under Legislative Joint Rule

89 (c) The commission's approval of a priority request under Subsection (8)(b) shall:
90 (i) be made at the request of the legislator who filed the priority request; and
91 (ii) be approved, by motion, in a meeting of the commission.
92 (d) This Subsection (8) has no effect on the commission's authority to open a
93 committee bill file under Section 63L-10-103.
94 Section 2. Effective date.
95 This bill takes effect on May 1, 2024.
