8 General Description:
9 This bill enacts provisions related to child and maternal health services.
10 Highlighted Provisions:

13 < requires the department to inform individuals about child and maternal health
14 services offered by state agencies; and
15 < allows a state agency to share an individual's information to facilitate access to child
16 and maternal health services if certain circumstances are met.

26 Section 1. Section 26B-7-122 is enacted to read:
27 26B-7-122. Maternal and child health services -- Information sharing within state
28 agencies.
29 (1) As used in this section:
30 (a) "Evidence-based early childhood home visiting services" means early childhood
31 services delivered using a service delivery model that meets the United States Department of
32 Health and Human Services criteria for an evidence-based early childhood home visiting
33 service delivery model.
34 (b) "Recipient" means an individual, or the individual's parent if the individual is a
35 minor, who receives services from the Division of Family Health, including evidence-based
36 early childhood home visiting services.
37 (c) "Universal consent form" means a form described in Subsection (4).
38 (2) The department shall ensure that a recipient is informed of any services offered by a
39 state agency that the recipient may be eligible to receive.
40 (3) Subject to appropriation, the department shall develop a process that will allow the
41 department to follow up directly or indirectly with a recipient to determine the degree to which
42 the recipient's needs have been addressed by services provided by the department.
43 (4) (a) The department shall develop a universal consent form that complies with all
44 relevant state and federal laws regarding information sharing for the facilitation of maternal
45 and child health services.
46 (b) An individual may complete the universal consent form to authorize a state agency
47 to share the individual's information with another state agency in order to facilitate providing
48 maternal and child health services.
49 (c) An individual may:
50 (i) limit which state agencies receive the individual's information; and
51 (ii) revoke the individual's consent for sharing the information at any time.
52 (d) A state agency, including a local education agency, shall:
53 (i) accept the form if the state agency offers maternal and child health services; and
54 (ii) share the individual's information with another state agency that offers maternal
55 and child health services in accordance with the individual's direction.
56 Section 2. Effective date.

57 This bill takes effect on May 1, 2024.
