7 LONG TITLE
8 General Description:
9 This bill creates the Office of Student Health Affairs (office) within the Department of
10 Health and Human Services (department).
11 Highlighted Provisions:
12 This bill:
13 < defines terms;
14 < creates the office within the department;
15 < creates a director to oversee the office;
16 < establishes the office's duties;
17 < creates a reporting requirement; and
18 < establishes a repeal date for some of the office's duties.

32 Be it enacted by the Legislature of the state of Utah:
33 Section 1. Section 26B-4-412 is enacted to read:
34 26B-4-412. Office of Student Health Affairs -- Creation -- Duties.
35 (1) As used in this section:
36 (a) "Director" means the director of the office appointed under Subsection (3).
37 (b) "Office" means the Office of Student Health Affairs created in this section.
38 (2) There is created within the department the Office of Student Health Affairs.
39 (3) (a) The executive director of the department shall appoint a director of the office
40 who:
41 (i) has a bachelor's degree in a health related field from an accredited university or
42 college;
43 (ii) is experienced in administration; and
44 (iii) is knowledgeable about education and health practices.
45 (b) The director is the administrative head of the office and shall serve under the
46 supervision of the executive director.
47 (c) The executive director may hire staff as necessary to carry out the duties of the
48 office described in Subsection (4).
49 (4) The office shall:
50 (a) oversee health services provided by the department for Utah's public education
51 system;
52 (b) coordinate with the State Board of Education and local health departments to
53 improve student access to parent approved health services including:
54 (i) physical wellness services;
55 (ii) mental health services; and
56 (iii) programs for the management of chronic health conditions;
57 (c) develop policies described in Subsection 53G-9-402(1)(a);
58 (d) assist schools in obtaining reimbursement for parent approved health care service

59 provided by the school to students who are enrolled in the Medicaid program; and
60 (e) establish a cooperative plan between the State Board of Education and local health
61 departments to minimize redundancy of service delivery and maximize coordination and access
62 to school health services.
63 (5) On or before November 1 of each year, the director shall provide a report to the
64 Health and Human Services Interim Committee and the Education Interim Committee
65 regarding:
66 (a) activities and accomplishments of the office; and
67 (b) recommendations for improving the delivery of student health services.
68 Section 2. Section 63I-1-226 (Effective 07/01/24) is amended to read:
69 63I-1-226 (Effective 07/01/24). Repeal dates: Titles 26A through 26B.
70 (1) Subsection 26B-1-204(2)(i), related to the Primary Care Grant Committee, is
71 repealed July 1, 2025.
72 (2) Section 26B-1-315, which creates the Medicaid Expansion Fund, is repealed July 1,
73 2024.
74 (3) Section 26B-1-319, which creates the Neuro-Rehabilitation Fund, is repealed
75 January 1, 2025.
76 (4) Section 26B-1-320, which creates the Pediatric Neuro-Rehabilitation Fund, is
77 repealed January 1, 2025.
78 (5) Subsection 26B-1-324(4), the language that states "the Behavioral Health Crisis
79 Response Commission, as defined in Section 63C-18-202," is repealed December 31, 2026.
80 (6) Subsection 26B-1-329(6), related to the Behavioral Health Crisis Response
81 Commission, is repealed December 31, 2026.
82 (7) Section 26B-1-402, related to the Rare Disease Advisory Council Grant Program, is
83 repealed July 1, 2026.
84 (8) Section 26B-1-409, which creates the Utah Digital Health Service Commission, is
85 repealed July 1, 2025.
86 (9) Section 26B-1-410, which creates the Primary Care Grant Committee, is repealed
87 July 1, 2025.
88 (10) Section 26B-1-416, which creates the Utah Children's Health Insurance Program
89 Advisory Council, is repealed July 1, 2025.

90 (11) Section 26B-1-417, which creates the Brain Injury Advisory Committee, is
91 repealed July 1, 2025.
92 (12) Section 26B-1-418, which creates the Neuro-Rehabilitation Fund and Pediatric
93 Neuro-Rehabilitation Fund Advisory Committee, is repealed January 1, 2025.
94 (13) Section 26B-1-422, which creates the Early Childhood Utah Advisory Council, is
95 repealed July 1, 2029.
96 (14) Section 26B-1-428, which creates the Youth Electronic Cigarette, Marijuana, and
97 Other Drug Prevention Program, is repealed July 1, 2025.
98 (15) Section 26B-1-430, which creates the Coordinating Council for Persons with
99 Disabilities, is repealed July 1, 2027.

109 hygienists, is repealed July 1, 2028.
110 [(21)] (20) Section 26B-3-136, which creates the Children's Health Care Coverage
111 Program, is repealed July 1, 2025.
112 [(22)] (21) Section 26B-3-137, related to reimbursement for the National Diabetes
113 Prevention Program, is repealed June 30, 2027.
114 [(23)] (22) Subsection 26B-3-213(2), the language that states "and the Behavioral
115 Health Crisis Response Commission created in Section 63C-18-202" is repealed December 31,
116 2026.

144 repealed.
145 (36) In relation to the Behavioral Health Crisis Response Commission, on December
146 31, 2026:
147 (a) Subsection 26B-5-609(1)(a) is repealed;
148 (b) Subsection 26B-5-609(3)(a), the language that states "With recommendations from
149 the commission," is repealed;
150 (c) Subsection 26B-5-610(1)(b) is repealed;
151 (d) Subsection 26B-5-610(2)(b), the language that states "and in consultation with the

153 (e) Subsection 26B-5-610(4), the language that states "In consultation with the
154 commission," is repealed.
155 (37) Subsections 26B-5-611(1)(a) and (10), in relation to the Utah Substance Use and
156 Mental Health Advisory Council, are repealed January 1, 2033.
157 (38) Section 26B-5-612, related to integrated behavioral health care grant programs, is
158 repealed December 31, 2025.
159 (39) Subsection 26B-7-119(5), related to reports to the Legislature on the outcomes of
160 the Hepatitis C Outreach Pilot Program, is repealed July 1, 2028.
161 (40) Section 26B-7-224, related to reports to the Legislature on violent incidents and
162 fatalities involving substance abuse, is repealed December 31, 2027.
163 (41) Title 26B, Chapter 8, Part 5, Utah Health Data Authority, is repealed July 1, 2024.
164 [(42) Section 26B-8-513, related to identifying overuse of non-evidence-based health
165 care, is repealed December 31, 2023.]
166 Section 3. Effective date.
167 This bill takes effect on July 1, 2024.
