4 General Description:
5 This bill addresses the regulation of public cold baths.
6 Highlighted Provisions:
7 This bill:
8 ▸ defines a public cold bath; and
9 ▸ prohibits the Department of Health and Human Services from regulating public cold
10 baths.

19 Be it enacted by the Legislature of the state of Utah:
20 Section 1. Section 26B-7-122 is enacted to read:
21 26B-7-122 . Rules for public cold baths.
22 (1) As used in this section, "public cold bath" means a tub or tank that:
23 (a) is used by:
24 (i) the general public, regardless of whether there is a charge or payment for use; and
25 (ii) one bather at a time;
26 (b) contains chilled water that is:
27 (i) maintained at a temperature lower than 60 degrees Fahrenheit;
28 (ii) no more than 180 gallons in volume; and

29 (iii) at a depth that allows the bather to maintain the bather's head above the water
30 while in a seated position; and
31 (c) continuously filters and sanitizes the chilled water.
32 (2) The department may not adopt a rule that restricts, limits, or imposes requirements on
33 the operation of a public cold bath.
34 Section 2. Effective date.
35 This bill takes effect on May 1, 2024.
