8 General Description:
9 This resolution modifies the fiscal note process.
10 Highlighted Provisions:
11 This resolution:
12 < modifies the process by which a sponsor consults with the legislative fiscal analyst
13 regarding a fiscal note; and
14 < makes technical and conforming changes.
15 Special Clauses:
16 This resolution provides a special effective date.

21 Be it resolved by the Legislature of the state of Utah:
22 Section 1. JR4-2-403 is amended to read:
23 JR4-2-403. Fiscal notes.
24 (1) (a) (i) When the legislative fiscal analyst receives the electronic copy of [the]
25 approved legislation from the Office of Legislative Research and General Counsel, [that office]

26 the legislative fiscal analyst shall, within three business days:
27 (A) review and analyze the legislation to determine [its] the legislation's fiscal impact;

28 and
29 (B) provide a fiscal note to the sponsor of the legislation.
30 (ii) To the extent reasonably necessary, the three day deadline for the preparation of the
31 fiscal note may be extended if:
32 (A) the legislative fiscal analyst requests [it] an extension, states the reasons for the
33 delay, and informs the sponsor of the legislation of the delay ; or
34 (B) the legislation affects public retirement benefits, requires an actuarial analysis to
35 prepare the fiscal note, and the legislative fiscal analyst informs the sponsor of the legislation
36 of the delay.
37 (b) If the legislative fiscal analyst determines that the legislation has no fiscal impact,
38 the legislative fiscal analyst may release the fiscal note immediately after providing the fiscal
39 note to the sponsor [has received a copy of the fiscal note].
40 (c) [The] Within one business day after the day on which the legislative fiscal analyst
41 provides a fiscal note to a sponsor, the sponsor may contact the legislative fiscal analyst:
42 (i) to approve the release of the fiscal note;
43 (ii) to direct that the fiscal note be held; or
44 (iii) [if the sponsor disagrees with the fiscal note, contact the legislative fiscal analyst
45 to discuss that disagreement and provide evidence, data, or other information to support a
46 revised fiscal note] to consult with the legislative fiscal analyst regarding:
47 (A) the factors that resulted in the legislative fiscal analyst's determination of the
48 legislation's fiscal impact; and
49 (B) potential changes to those factors or the legislation that would affect the
50 legislation's fiscal impact.
51 (d) If [the] a sponsor does not contact the legislative fiscal analyst [with instructions
52 about the fiscal note within one 24 hour legislative day] as provided in Subsection (2)(c), the
53 legislative fiscal analyst shall release the fiscal note.
54 (e) The legislative fiscal analyst shall make the final determination on the fiscal note.
55 (f) The fiscal note shall be printed with the legislation.
56 (2) If an amendment or a substitute to legislation appears to substantively change the
57 fiscal impact of the legislation, the legislative fiscal analyst shall prepare an amended fiscal
58 note for the legislation.

59 (3) The fiscal note is not an official part of the legislation.
60 Section 2. Effective date.
61 This resolution takes effect upon a successful vote for final passage.
