7 LONG TITLE
8 General Description:
9 This bill enacts a conditional disclosure requirement on health care providers who
10 administer vaccines.
11 Highlighted Provisions:
12 This bill:
13 < defines terms; and
14 < establishes disclosure requirements for a health care provider that earns incentive
15 compensation for administering a vaccine.
16 Money Appropriated in this Bill:

18 Other Special Clauses:
19 This bill provides a special effective date.

24 Be it enacted by the Legislature of the state of Utah:
25 Section 1. Section 26B-4-321.1 is enacted to read:

26 26B-4-321.1. Disclosure of vaccination compensation.
27 (1) As used in this section, "incentive compensation" means any payment or other
28 benefit that:
29 (a) serves as a reward to a health care provider;
30 (b) the health care provider may only earn, in whole, for administering a vaccine; and
31 (c) is in addition to the health care provider's regular compensation, salary, or wage.
32 (2) If a health care provider, as defined in Section 76B-3-403, is a candidate to receive
33 incentive compensation for the administration of a vaccine to a patient, the health care provider
34 shall make a disclosure to the patient:
35 (a) prior to administering the vaccine;
36 (b) in writing, including:
37 (i) by email;
38 (ii) as part of the patient's contract for services;
39 (iii) as part of other written communications or set of disclosures made to the patient;
40 or
41 (iv) as a separate disclosure;
42 (c) showing the total value of incentive compensation; and
43 (d) identifying the individual or entity obligated to pay the incentive compensation.
44 Section 2. Effective date.
45 This bill takes effect on May 1, 2025.
