7 LONG TITLE
8 General Description:
9 This bill modifies funding provisions related to the Division of State Parks.
10 Highlighted Provisions:
11 This bill:
12 < allows interest earned on the money in the State Park Fees Restricted Account to
13 remain in the account;
14 < allows proceeds earned from the sale or disposal of buffalo to be used for the
15 prevention and compensation of damage caused by buffalo herds; and
16 < repeals a section of the code requiring the Legislature to appropriate money to the
17 Division of State Parks for boating account expenses.

29 Be it enacted by the Legislature of the state of Utah:
30 Section 1. Section 79-4-402 is amended to read:
31 79-4-402. State Park Fees Restricted Account.
32 (1) There is created within the General Fund a restricted account known as the State
33 Park Fees Restricted Account.
34 (2) (a) Except as provided in Subsection (2)(b), the account [shall consist] consists of
35 revenue from:
36 (i) all charges allowed under Section 79-4-203;
37 (ii) proceeds from the sale or disposal of buffalo under Subsection 79-4-1001(2)(b);
38 [and]
39 (iii) civil damages collected under Section 76-6-206.2; and
40 (iv) interest on account money.
41 (b) The account shall not include revenue the division receives under Section 79-4-403
42 and Subsection 79-4-1001(2)(a).
43 (3) The division shall use funds in this account for the purposes described in Section
44 79-4-203.
45 Section 2. Section 79-4-1001 is amended to read:
46 79-4-1001. Purchase, trade, sale, or disposal of buffalo -- Proceeds.
47 (1) In accordance with a plan, approved by the board, to manage buffalo herds on
48 Antelope Island, the division may purchase, trade, sell, or dispose of buffalo obtained from
49 Antelope Island through:
50 (a) competitive bidding; or
51 (b) a means as established by rule.
52 (2) Proceeds received from the sale or disposal of buffalo under this section shall be
53 deposited as follows:
54 (a) the first $75,000 shall accrue to the division for the management of Antelope Island
55 buffalo herds as dedicated credits;
56 (b) the next $100,000 shall accrue to the division for the prevention and compensation

57 of damage caused by buffalo herds as dedicated credits; and
58 [(b)] (c) proceeds in excess of [$75,000] $175,000 shall be deposited in the State Park
59 Fees Restricted Account created under Section 79-4-402.
60 Section 3. Repealer.
61 This bill repeals:
62 Section 79-4-401, Funds to be appropriated -- Boating account expenses.
63 Section 4. Effective date.
64 This bill takes effect on May 1, 2024.
