                                 A BILL


 
To establish a rule of construction regarding consent for disclosure of 
personally identifiable information under the Family Educational Rights 
                        and Privacy Act of 1974.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Student Voter Data Protection Act''.

SEC. 2. FERPA RULE.

    Section 444 of the General Education Provisions Act (20 U.S.C. 
1232g, commonly known as the ``Family Educational Rights and Privacy 
Act of 1974'') is amended by adding at the end the following:
    ``(k) Nothing in this section shall be interpreted or construed to 
allow an educational agency or institution to disclose personally 
identifiable information, including directory information, from a 
student for the purpose of measuring voter registration or the voting 
rates of students enrolled at an institution of higher education, 
without the consent required by this section, including consent 
specified in section 99.30 of title 34, Code of Federal Regulations (or 
any successor regulations).''.
